99 AN ACT
1010 relating to the procedure for certain small local exchange
1111 companies to propose to offer certain services or to make a minor
1212 change in a rate or tariff.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 53.301, Utilities Code, is amended to
1515 read as follows:
1616 Sec. 53.301. DEFINITION. (a) In this subchapter, "minor
1717 change" means a change, including the restructuring of rates of
1818 existing services, that:
1919 (1) decreases the rates or revenues of an incumbent
2020 local exchange company; or
2121 (2) together with any other rate change [or proposed]
2222 or approved tariff changes in the 12 months preceding the effective
2323 date of the proposed change, increases the company's total
2424 regulated intrastate gross annual revenues by not more than five
2525 percent.
2626 (b) With regard to a change to a basic local access line
2727 rate, a "minor change" does not include a change that, together with
2828 any other change to the basic local access line rate that took
2929 effect during the 12 months preceding the effective date of the
3030 proposed change, results in an increase of more than 50 [10]
3131 percent.
3232 SECTION 2. Section 53.304, Utilities Code, is amended to
3333 read as follows:
3434 Sec. 53.304. PROCEDURE TO OFFER CERTAIN SERVICES OR MAKE
3535 MINOR CHANGES. (a) An incumbent local exchange company may offer
3636 an extended local calling service, a packaged service, or a new or
3737 promotional service on an optional basis or make a minor change in
3838 its rates or tariffs if the company:
3939 (1) is a cooperative corporation or has, together with
4040 all affiliated incumbent local exchange companies, fewer than
4141 31,000 access lines in service in this state;
4242 (2) files with the commission and the office notice [a
4343 statement of intent], as prescribed by Subsection (b), not later
4444 than the 10th [91st] day before the effective date of the proposed
4545 change;
4646 (3) provides notice as prescribed by Section 53.305;
4747 and
4848 (4) files with the commission affidavits verifying
4949 that notice as prescribed by Section 53.305 was provided.
5050 (b) The notice [statement of intent] must include:
5151 (1) a copy of a resolution adopted by the incumbent
5252 local exchange company's board of directors approving the proposed
5353 change;
5454 (2) a description of the services affected by the
5555 proposed change;
5656 (3) a copy of the proposed tariff for the affected
5757 service;
5858 (4) a copy of the customer notice required by
5959 Subsection (a)(3);
6060 (5) the number of access lines the company and each
6161 affiliate have in service in this state; and
6262 (6) the amount by which the company's total regulated
6363 intrastate gross annual revenues will increase or decrease as a
6464 result of the proposed change.
6565 SECTION 3. Section 53.305(b), Utilities Code, is amended to
6666 read as follows:
6767 (b) Notice must:
6868 (1) be provided not later than the 10th [61st] day
6969 before the effective date of the proposed change; and
7070 (2) include:
7171 (A) a description of the services affected by the
7272 proposed change;
7373 (B) the effective date of the proposed change;
7474 (C) an explanation of the customer's right to
7575 petition the commission for a review under Section 53.306,
7676 including the number of persons required to petition before a
7777 commission review will occur;
7878 (D) an explanation of the customer's right to
7979 information concerning how to obtain a copy of the proposed tariff
8080 from the company;
8181 (E) the amount by which the company's total
8282 regulated intrastate gross annual revenues will increase or
8383 decrease as a result of the proposed change; and
8484 (F) a list of rates that are affected by the
8585 proposed rate change.
8686 SECTION 4. This Act applies only to a proposal to offer a
8787 service or to change a rate or tariff notice of which is filed on or
8888 after the effective date of this Act. A proposal to offer a service
8989 or to change a rate or tariff for which a statement of intent is
9090 filed before the effective date of this Act is governed by the law
9191 in effect on the date the statement was filed, and that law is
9292 continued in effect for that purpose.
9393 SECTION 5. This Act takes effect September 1, 2011.
