 A BILL TO BE ENTITLED
 AN ACT
 relating to requiring health and human services agencies to give
 preference to certain persons in making hiring decisions.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter A, Chapter 531, Government Code, is
 amended by adding Section 531.0092 to read as follows:
 Sec. 531.0092.  EMPLOYMENT PREFERENCE. (a) An individual
 who received services from a health and human services agency
 before the individual's 18th birthday or who is the parent or
 caretaker of a child who received services from a health and human
 services agency is entitled to a preference in employment with an
 agency from which the individual or the individual's child received
 services over other applicants for the same position who do not have
 greater qualifications.
 (b)  A health and human services agency shall require an
 entity that contracts with the agency to directly provide health
 and human services to children and families to give preference in
 making hiring decisions to an individual who received services from
 the agency before the individual's 18th birthday or who is the
 parent or caretaker of a child who received services from the agency
 over other applicants for the same position who do not have greater
 qualifications.
 (c)  This section does not apply to:
 (1)  the position of private secretary or deputy of an
 official or department; or
 (2)  an individual holding a strictly confidential
 relationship with the employing officer.
 SECTION 2.  This Act takes effect September 1, 2011.
