99 relating to energy and efficiency conservation programs
1010 administered by the Texas Public Utility Commission.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 39.905(d), Utilities Code, is amended to
1313 read as follows:
1414 (d) The commission shall establish a procedure for
1515 reviewing and evaluating market-transformation program options
1616 described by this subsection and other options. In evaluating
1717 program options, the commission may consider the ability of a
1818 program option to reduce costs to customers through reduced demand,
1919 energy savings, and relief of congestion. Utilities may choose to
2020 implement any program option approved by the commission after its
2121 evaluation in order to satisfy the goal in Subsection (a),
2222 including:
2323 (1) energy-smart schools;
2424 (2) appliance retirement and recycling;
2525 (3) air conditioning system tune-ups;
2626 (4) the use of trees or other landscaping for energy
2727 efficiency;
2828 (5) customer energy management and demand response
2929 programs;
3030 (6) high performance residential and commercial
3131 buildings that will achieve the levels of energy efficiency
3232 sufficient to qualify those buildings for federal tax incentives;
3333 (7) programs for customers who rent or lease their
3434 residence or commercial space;
3535 (8) programs providing energy monitoring equipment to
3636 customers that enable a customer to better understand the amount,
3737 price, and time of the customer's energy use;
3838 (9) energy audit programs for owners and other
3939 residents of single-family or multifamily residences and for small
4040 commercial customers;
4141 (10) net-zero energy new home programs;
4242 (11) solar thermal or solar electric programs; [and]
4343 (12) programs for using windows and other glazing
4444 systems, glass doors, and skylights in residential and commercial
4545 buildings that reduce solar gain by at least 30 percent from the
4646 level established for the federal Energy Star windows program; and
4747 (13) energy use programs with measurable and
4848 verifiable results that reduce energy consumption through
4949 behavioral changes that lead to efficient use patterns and
5050 practices.
5151 SECTION 2. This Act takes effect immediately if it receives
5252 a vote of two-thirds of all the members elected to each house, as
5353 provided by Section 39, Article III, Texas Constitution. If this
5454 Act does not receive the vote necessary for immediate effect, this
5555 Act takes effect September 1, 2011.
