99 relating to notice of premium increase for certain health benefit
1010 plans.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter F, Chapter 843, Insurance Code, is
1313 amended by adding Section 843.2071 to read as follows:
1414 Sec. 843.2071. NOTICE OF INCREASE IN CHARGE FOR COVERAGE.
1515 (a) Not less than 60 days before the date on which an increase in a
1616 charge for coverage under this chapter takes effect, a health
1717 maintenance organization shall:
1818 (1) give to each enrollee under an individual evidence
1919 of coverage written notice of the effective date of the increase;
2020 and
2121 (2) provide the enrollee a table that clearly lists:
2222 (A) the actual dollar amount of the charge for
2323 coverage on the date of the notice;
2424 (B) the actual dollar amount of the charge for
2525 coverage after the charge increase; and
2626 (C) the percentage change between the amounts
2727 described by Paragraphs (A) and (B).
2828 (b) The notice required by this section must be based on
2929 coverage in effect on the date of the notice.
3030 (c) This section may not be construed to prevent a health
3131 maintenance organization, at the request of an enrollee, from
3232 negotiating a change in benefits or rates after delivery of the
3333 notice required by this section.
3434 (d) A health maintenance organization may not require an
3535 enrollee entitled to notice under this section to respond to the
3636 health maintenance organization to renew the coverage or take other
3737 action relating to the renewal or extension of the coverage before
3838 the 45th day after the date the notice described by Subsection (a)
3939 is given.
4040 (e) The notice required by this section must include:
4141 (1) contact information for the department, including
4242 information concerning how to file a complaint with the department;
4343 (2) contact information for the Texas Consumer Health
4444 Assistance Program, including information concerning how to
4545 request from the program consumer protection information or
4646 assistance with filing a complaint; and
4747 (3) the addresses of Internet websites that provide
4848 consumer information related to rate increase justifications,
4949 including the websites of the department and the United States
5050 Department of Health and Human Services.
5151 SECTION 2. Subchapter C, Chapter 1201, Insurance Code, is
5252 amended by adding Section 1201.109 to read as follows:
5353 Sec. 1201.109. NOTICE OF RATE INCREASE. (a) Not less than
5454 60 days before the date on which a premium rate increase takes
5555 effect on an individual accident and health insurance policy
5656 delivered or issued for delivery in this state by an insurer, the
5757 insurer shall:
5858 (1) give written notice to the insured of the
5959 effective date of the increase; and
6060 (2) provide the insured a table that clearly lists:
6161 (A) the actual dollar amount of the premium on
6262 the date of the notice;
6363 (B) the actual dollar amount of the premium after
6464 the premium rate increase; and
6565 (C) the percentage change between the amounts
6666 described by Paragraphs (A) and (B).
6767 (b) The notice required by this section must be based on
6868 coverage in effect on the date of the notice.
6969 (c) This section may not be construed to prevent an insurer,
7070 at the request of an insured, from negotiating a change in benefits
7171 or rates after delivery of the notice required by this section.
7272 (d) An insurer may not require an insured entitled to notice
7373 under this section to respond to the insurer to renew the policy or
7474 take other action relating to the renewal or extension of the policy
7575 before the 45th day after the date the notice described by
7676 Subsection (a) is given.
7777 (e) The notice required by this section must include:
7878 (1) contact information for the department, including
7979 information concerning how to file a complaint with the department;
8080 (2) contact information for the Texas Consumer Health
8181 Assistance Program, including information concerning how to
8282 request from the program consumer protection information or
8383 assistance with filing a complaint; and
8484 (3) the addresses of Internet websites that provide
8585 consumer information related to rate increase justifications,
8686 including the websites of the department and the United States
8787 Department of Health and Human Services.
8888 SECTION 3. Subchapter E, Chapter 1501, Insurance Code, is
8989 amended by adding Section 1501.216 to read as follows:
9090 Sec. 1501.216. PREMIUM RATES: NOTICE OF INCREASE. (a) Not
9191 less than 60 days before the date on which a premium rate increase
9292 takes effect on a small employer health benefit plan delivered or
9393 issued for delivery in this state by an insurer, the insurer shall:
9494 (1) give written notice to the small employer of the
9595 effective date of the increase; and
9696 (2) provide the small employer a table that clearly
9797 lists:
9898 (A) the actual dollar amount of the premium on
9999 the date of the notice;
100100 (B) the actual dollar amount of the premium after
101101 the premium rate increase; and
102102 (C) the percentage change between the amounts
103103 described by Paragraphs (A) and (B).
104104 (b) The notice required by this section must be based on
105105 coverage in effect on the date of the notice.
106106 (c) This section may not be construed to prevent an insurer,
107107 at the request of a small employer, from negotiating a change in
108108 benefits or rates after delivery of the notice required by this
109109 section.
110110 (d) An insurer may not require a small employer entitled to
111111 notice under this section to respond to the insurer to renew the
112112 policy or take other action relating to the renewal or extension of
113113 the policy before the 45th day after the date the notice described
114114 by Subsection (a) is given.
115115 (e) The notice required by this section must include:
116116 (1) contact information for the department, including
117117 information concerning how to file a complaint with the department;
118118 (2) contact information for the Texas Consumer Health
119119 Assistance Program, including information concerning how to
120120 request from the program consumer protection information or
121121 assistance with filing a complaint; and
122122 (3) the addresses of Internet websites that provide
123123 consumer information related to rate increase justifications,
124124 including the websites of the department and the United States
125125 Department of Health and Human Services.
126126 SECTION 4. This Act applies to a health maintenance
127127 organization individual evidence of coverage, an individual
128128 accident and health insurance policy, or a small employer health
129129 benefit plan that is delivered, issued for delivery, or renewed on
130130 or after the effective date of this Act. An evidence of coverage,
131131 policy, or plan delivered, issued for delivery, or renewed before
132132 the effective date of this Act is governed by the law as it existed
133133 immediately before the effective date of this Act, and that law is
134134 continued in effect for that purpose.
135135 SECTION 5. This Act takes effect September 1, 2011.
