99 relating to pretrial hearings in criminal cases.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Article 28.01, Code of Criminal Procedure, is
1212 amended by adding Section 4 to read as follows:
1313 Sec. 4. A court shall set a pre-trial hearing in any
1414 criminal case if, not later than the 60th day before the date on
1515 which trial commences, the state or the defendant requests the
1616 hearing. The court must hold the requested hearing not later than
1717 the 30th day before the date on which trial commences.
1818 SECTION 2. This Act applies only to a criminal case in which
1919 the indictment or information is presented to the court on or after
2020 the effective date of this Act. A criminal case in which the
2121 indictment or information is presented to the court before the
2222 effective date of this Act is governed by the law in effect when the
2323 indictment or information is presented, and the former law is
2424 continued in effect for that purpose.
2525 SECTION 3. This Act takes effect September 1, 2011.
