1010 AN ACT
1111 relating to the operation and efficiency of the eligibility
1212 determination process for supplemental nutrition assistance
1313 program benefits.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Chapter 33, Human Resources Code, is amended by
1616 designating Sections 33.0005 through 33.028 as Subchapter A and
1717 adding a subchapter heading to read as follows:
1818 SUBCHAPTER A. NUTRITIONAL ASSISTANCE PROGRAMS IN GENERAL
1919 SECTION 2. Chapter 33, Human Resources Code, is amended by
2020 adding Subchapter B to read as follows:
2121 SUBCHAPTER B. SUPPLEMENTAL NUTRITION ASSISTANCE PROGRAM:
2222 ELIGIBILITY DETERMINATION PROCESS EFFICIENCY
2323 Sec. 33.051. DEFINITIONS. In this subchapter:
2424 (1) "Commission" means the Health and Human Services
2525 Commission.
2626 (2) "Supplemental nutrition assistance program" means
2727 the nutritional assistance program formerly referred to as the food
2828 stamp program.
2929 Sec. 33.052. APPLICATION ASSISTANCE. (a) The commission
3030 shall develop procedures to ensure that:
3131 (1) clear guidance on program eligibility
3232 requirements is provided to supplemental nutrition assistance
3333 applicants and prospective applicants and mechanisms are
3434 established, including Internet and e-mail mechanisms, as
3535 appropriate, by which applicants can obtain answers to basic
3636 program-related questions; and
3737 (2) information is provided to each applicant in
3838 person, by e-mail, by telephone, or through the mail, as
3939 appropriate, about information the applicant is required to submit
4040 for purposes of the eligibility determination process.
4141 (b) The commission shall consider the feasibility and
4242 cost-effectiveness of using office personnel or an automated system
4343 or systems to support the eligibility determination process by
4444 contacting an applicant in advance of an applicant's scheduled
4545 interview to remind the applicant of the interview and the
4646 documentation that must be presented at the interview.
4747 Sec. 33.053. USE OF TECHNOLOGY TO PROMOTE EFFICIENCY AND
4848 FRAUD DETECTION. (a) The commission shall consider the
4949 feasibility and cost-effectiveness of using readily available
5050 document scanning technology to reduce storage and maintenance
5151 costs and potential loss of data by creating electronic case files
5252 for supplemental nutrition assistance cases instead of maintaining
5353 physical files for those cases. The commission shall use that
5454 technology if determined feasible and cost-effective.
5555 (b) The commission shall implement, if feasible and
5656 cost-effective, a risk scoring program for supplemental nutrition
5757 assistance applications to streamline the eligibility
5858 determination process, reduce errors, and strengthen fraud
5959 detection. A risk scoring program implemented by the commission
6060 must be capable of ranking applications based on complexity so
6161 that:
6262 (1) more experienced eligibility determination staff
6363 members can be used to process more difficult cases and cases with
6464 fraud characteristics; and
6565 (2) applications ranked as low-risk on fraud
6666 characteristics can be processed more expeditiously.
6767 Sec. 33.054. WORKFORCE MANAGEMENT. The commission shall
6868 improve its management of supplemental nutrition assistance
6969 eligibility determination staff by:
7070 (1) establishing clear performance expectations that
7171 can serve as the basis for performance assessments;
7272 (2) planning for anticipated staffing needs;
7373 (3) revising policies regarding overtime and accrual
7474 of compensatory time to ensure that eligibility determination staff
7575 members have access to supervisors as necessary;
7676 (4) assessing the effectiveness of training provided
7777 to new eligibility determination staff members; and
7878 (5) evaluating the compensation of eligibility
7979 determination staff members to determine if the compensation is
8080 sufficient to recruit qualified staff members and retain
8181 experienced staff members.
8282 Sec. 33.055. PROGRAM MANAGEMENT INFORMATION. (a) The
8383 commission, in conjunction with state, regional, and local
8484 eligibility determination offices, shall identify eligibility
8585 determination program performance indicators with respect to which
8686 data should periodically be collected. The commission shall
8787 implement a process for collecting data on the identified
8888 performance indicators.
8989 (b) The commission shall provide periodic management
9090 reports generated by the automated eligibility system to
9191 eligibility determination offices. The reports must include
9292 information regarding the number of pending supplemental nutrition
9393 assistance applications and the number of those applications that
9494 have not been processed within applicable timeliness standards.
9595 (c) The commission shall use data collected under
9696 Subsection (a) and the reports described by Subsection (b) to
9797 develop and assess strategies for:
9898 (1) streamlining the supplemental nutrition
9999 assistance eligibility determination process;
100100 (2) improving timeliness of eligibility
101101 determinations; and
102102 (3) accommodating increases in applications received.
103103 SECTION 3. To the extent available for this purpose, the
104104 Health and Human Services Commission shall use supplemental federal
105105 funding provided for the administration of the supplemental
106106 nutrition assistance program to implement Subchapter B, Chapter 33,
107107 Human Resources Code, as added by this Act.
108108 SECTION 4. This Act takes effect September 1, 2011.
