99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1111 Code, is amended by adding Chapter 8343 to read as follows:
1212 CHAPTER 8343. RANCH AT CLEAR FORK CREEK MUNICIPAL UTILITY DISTRICT

1414 SUBCHAPTER A. GENERAL PROVISIONS
1515 Sec. 8343.001. DEFINITIONS. In this chapter:
1616 (1) "Board" means the district's board of directors.
1717 (2) "Commission" means the Texas Commission on
1818 Environmental Quality.
1919 (3) "Director" means a board member.
2020 (4) "District" means the Ranch at Clear Fork Creek
2121 Municipal Utility District No. 1.
2222 Sec. 8343.002. NATURE OF DISTRICT. The district is a
2323 municipal utility district created under Section 59, Article XVI,
2424 Texas Constitution.
2525 Sec. 8343.003. CONFIRMATION AND DIRECTORS' ELECTION
2626 REQUIRED. The temporary directors shall hold an election to
2727 confirm the creation of the district and to elect five permanent
2828 directors as provided by Section 49.102, Water Code.
2929 Sec. 8343.004. CONSENT OF MUNICIPALITY REQUIRED. The
3030 temporary directors may not hold an election under Section 8343.003
3131 until each municipality in whose corporate limits or
3232 extraterritorial jurisdiction the territory added by Section
3333 8343.005 is located has consented by ordinance or resolution to the
3434 inclusion of land in the district.
3535 Sec. 8343.005. TERRITORY ADDED. (a) The territory
3636 described by Section 2 of the Act enacting this chapter is added to
3737 the district's territory as of the effective date of this section.
3838 (b) The boundaries and field notes contained in Section 2 of
3939 the Act enacting this chapter form a closure. A mistake made in the
4040 field notes or in copying the field notes in the legislative process
4141 does not affect the district's:
4242 (1) organization, existence, or validity;
4343 (2) right to issue any type of bond for the purposes
4444 for which the district is created or to pay the principal of and
4545 interest on a bond;
4646 (3) right to impose a tax; or
4747 (4) legality or operation.

4949 SUBCHAPTER B. BOARD OF DIRECTORS
5050 Sec. 8343.051. GOVERNING BODY; TERMS. (a) The district is
5151 governed by a board of five elected directors.
5252 (b) Except as provided by Section 8343.052, directors serve
5353 staggered four-year terms.
5454 Sec. 8343.052. TEMPORARY DIRECTORS. (a) The temporary
5555 board consists of:
5656 (1) Julie Lane;
5757 (2) Heidi Parker;
5858 (3) Jerry Valdez;
5959 (4) Craig Grona; and
6060 (5) Bruce Aupperle.
6161 (b) Temporary directors serve until the earlier of:
6262 (1) the date permanent directors are elected under
6363 Section 8343.003; or
6464 (2) the fourth anniversary of the effective date of
6565 the Act enacting this chapter.
6666 (c) If permanent directors have not been elected under
6767 Section 8343.003 and the terms of the temporary directors have
6868 expired, successor temporary directors shall be appointed or
6969 reappointed as provided by Subsection (d) to serve terms that
7070 expire on the earlier of:
7171 (1) the date permanent directors are elected under
7272 Section 8343.003; or
7373 (2) the fourth anniversary of the date of the
7474 appointment or reappointment.
7575 (d) If Subsection (c) applies, the owner or owners of a
7676 majority of the assessed value of the real property in the district
7777 may submit a petition to the commission requesting that the
7878 commission appoint as successor temporary directors the five
7979 persons named in the petition. The commission shall appoint as
8080 successor temporary directors the five persons named in the
8181 petition.

8383 SUBCHAPTER C. POWERS AND DUTIES
8484 Sec. 8343.101. MUNICIPAL UTILITY DISTRICT POWERS AND
8585 DUTIES. The district has the powers and duties provided by the
8686 general law of this state, including Chapters 49 and 54, Water Code,
8787 applicable to municipal utility districts created under Section 59,
8888 Article XVI, Texas Constitution.
8989 Sec. 8343.102. AUTHORITY FOR ROAD PROJECTS. Under Section
9090 52, Article III, Texas Constitution, the district may design,
9191 acquire, construct, finance, issue bonds for, improve, operate,
9292 maintain, and convey to this state, a county, or a municipality for
9393 operation and maintenance macadamized, graveled, or paved roads,
9494 including bridges, storm drainage, and other improvements or
9595 appurtenances in aid of those roads.
9696 Sec. 8343.103. ROAD STANDARDS AND REQUIREMENTS. (a) A road
9797 project must meet all applicable construction standards, zoning and
9898 subdivision requirements, and regulations of each municipality in
9999 whose corporate limits or extraterritorial jurisdiction the road
100100 project is located.
101101 (b) If a road project is not located in the corporate limits
102102 or extraterritorial jurisdiction of a municipality, the road
103103 project must meet all applicable construction standards,
104104 subdivision requirements, and regulations of each county in which
105105 the road project is located.
106106 (c) If a municipality or county will maintain and operate
107107 the road, the municipality or county must approve the plans and
108108 specifications of the road project.
109109 (d) If the state will maintain and operate the road, the
110110 Texas Transportation Commission must approve the plans and
111111 specifications of the road project.
112112 Sec. 8343.104. LIMITATION ON USE OF EMINENT DOMAIN. The
113113 district may not exercise the power of eminent domain outside the
114114 district to acquire a site or easement for:
115115 (1) a road project authorized by Section 8343.102; or
116116 (2) a recreational facility as defined by Section
117117 49.462, Water Code.

119119 SUBCHAPTER D. DIVISION OF DISTRICT INTO MULTIPLE DISTRICTS
120120 Sec. 8343.151. DIVISION OF DISTRICT; PREREQUISITES. The
121121 district may be divided into two or more new districts only if the
122122 district:
123123 (1) has no outstanding bonded debt; and
124124 (2) is not imposing ad valorem taxes or assessments.
125125 Sec. 8343.152. LAW APPLICABLE TO NEW DISTRICT. This
126126 chapter applies to any new district created by division of the
127127 district, and a new district has all the powers and duties of the
128128 district, including the power to divide in accordance with this
129129 section.
130130 Sec. 8343.153. LIMITATION ON AREA OF NEW DISTRICT. A new
131131 district created by the division of the district may not, at the
132132 time the new district is created, contain any land outside the
133133 combined area of:
134134 (1) the territory of the district at the time the
135135 district was initially created; and
136136 (2) the area added by Section 8343.005.
137137 Sec. 8343.154. DIVISION PROCEDURES. (a) The board, on its
138138 own motion or on receipt of a petition signed by the owner or owners
139139 of a majority of the assessed value of the real property in the
140140 district according to the most recent appraisal roll for each
141141 county in which the district is located, may adopt an order dividing
142142 the district.
143143 (b) The board may adopt an order dividing the district
144144 before or after the date the board holds an election under Section
145145 8343.003 to confirm the district's creation.
146146 (c) An order dividing the district:
147147 (1) must:
148148 (A) name each new district;
149149 (B) include the metes and bounds description of
150150 the territory of each new district;
151151 (C) appoint temporary directors for each new
152152 district; and
153153 (D) provide for the division of assets and
154154 liabilities between or among the new districts; and
155155 (2) is subject to a confirmation election in each new
156156 district.
157157 (d) On or before the 30th day after the date of adoption of
158158 an order dividing the district, the district shall file the order
159159 with the commission and record the order in the real property
160160 records of each county in which the district is located.
161161 Sec. 8343.155. CONFIRMATION ELECTION FOR NEW DISTRICT. (a)
162162 A new district created by the division of the district shall hold a
163163 confirmation and directors' election as required by Section
164164 8343.003.
165165 (b) The results of that election must be filed as required
166166 by Sections 49.102(e) and (f), Water Code.
167167 (c) The division of the district is not effective unless the
168168 voters of each proposed new district vote to confirm the creation of
169169 their new district.
170170 Sec. 8343.156. MUNICIPAL CONSENT. Municipal consent to the
171171 creation of the district and to the inclusion of land in the
172172 district granted under Section 8343.004 acts as municipal consent
173173 to the creation of any new district created by the division of the
174174 district and to the inclusion of land in the new district.
175175 Sec. 8343.157. TAX OR BOND ELECTION. Before a new district
176176 created by the division of the district may impose a maintenance tax
177177 or issue bonds payable wholly or partly from ad valorem taxes, the
178178 new district must hold an election as required by Chapters 49 and
179179 54, Water Code, and this chapter to obtain voter approval.

181181 SUBCHAPTER E. GENERAL FINANCIAL PROVISIONS
182182 Sec. 8343.201. TAX TO REPAY BONDS. The district may impose
183183 a tax to pay the principal of or interest on bonds issued under
184184 Section 8343.251.

186186 SUBCHAPTER F. BONDS AND OTHER OBLIGATIONS
187187 Sec. 8343.251. BONDS FOR ROAD PROJECTS. (a) The district
188188 may not issue bonds payable from ad valorem taxes to finance a road
189189 project unless the issuance is approved by a vote of a two-thirds
190190 majority of the district voters voting at an election held for that
191191 purpose.
192192 (b) At the time of issuance, the total principal amount of
193193 bonds or other obligations issued or incurred to finance road
194194 projects and payable from ad valorem taxes may not exceed
195195 one-fourth of the assessed value of the real property in the
196196 district.
197197 SECTION 2. The Ranch at Clear Fork Creek Municipal Utility
198198 District No. 1 includes all the territory contained in the
199199 following area in addition to the district's territory immediately
200200 before the effective date of this Act:
201201 203.47 ACRE TRACT
202202 DESCRIBING A TRACT OF LAND CONTAINING 203.47 ACRES IN THE THOMAS
203203 YATES SURVEY, ABSTRACT NO. 313, CALDWELL COUNTY, TEXAS, SAID TRACT
204204 BEING ALL OF THE FOLLOWING TWO TRACT OF LAND:
205205 1) THAT CERTAIN 151.60 ACRE TRACT OF LAND DESCRIBED IN A SPECIAL
206206 WARRANTY DEED TO WALTON TEXAS, LP, EXECUTED ON OCTOBER 21, 2009 AND
207207 RECORDED IN VOLUME 584 PAGE 282 OF THE OFFICIAL PUBLIC RECORDS OF

560560 SECTION 3. (a) The legal notice of the intention to
561561 introduce this Act, setting forth the general substance of this
562562 Act, has been published as provided by law, and the notice and a
563563 copy of this Act have been furnished to all persons, agencies,
564564 officials, or entities to which they are required to be furnished
565565 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
566566 Government Code.
567567 (b) The governor, one of the required recipients, has
568568 submitted the notice and Act to the Texas Commission on
569569 Environmental Quality.
570570 (c) The Texas Commission on Environmental Quality has filed
571571 its recommendations relating to this Act with the governor, the
572572 lieutenant governor, and the speaker of the house of
573573 representatives within the required time.
574574 (d) All requirements of the constitution and laws of this
575575 state and the rules and procedures of the legislature with respect
576576 to the notice, introduction, and passage of this Act are fulfilled
577577 and accomplished.
578578 SECTION 4. (a) Section 8343.104, Special District Local
579579 Laws Code, as added by Section 1 of this Act, takes effect only if
580580 this Act receives a two-thirds vote of all the members elected to
581581 each house.
582582 (b) If this Act does not receive a two-thirds vote of all the
583583 members elected to each house, Subchapter C, Chapter 8343, Special
584584 District Local Laws Code, as added by Section 1 of this Act, is
585585 amended by adding Section 8343.104 to read as follows:
586586 Sec. 8343.104. NO EMINENT DOMAIN POWER. The district may
587587 not exercise the power of eminent domain.
588588 (c) This section is not intended to be an expression of a
589589 legislative interpretation of the requirements of Section 17(c),
590590 Article I, Texas Constitution.
591591 SECTION 5. Except as provided by Section 4 of this Act:
592592 (1) this Act takes effect immediately if it receives a
593593 vote of two-thirds of all the members elected to each house, as
594594 provided by Section 39, Article III, Texas Constitution; and
595595 (2) if this Act does not receive the vote necessary for
596596 immediate effect, this Act takes effect September 1, 2011.
