| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 12.110(c), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (c) As part of the application procedure, the board: |
|---|
| 13 | 13 | | (1) to determine parental and community support for a |
|---|
| 14 | 14 | | charter for an open-enrollment charter school, shall hold a public |
|---|
| 15 | 15 | | hearing in the geographical area that, under Subsection (b) and |
|---|
| 16 | 16 | | Section 12.111(a)(14), is described in the application form; and |
|---|
| 17 | 17 | | (2) may require a petition supporting a charter for |
|---|
| 18 | 18 | | the [a] school signed by a specified number of parents or guardians |
|---|
| 19 | 19 | | of school-age children residing in the area [in which a school is |
|---|
| 20 | 20 | | proposed or may hold a public hearing to determine parental support |
|---|
| 21 | 21 | | for the school]. |

| 22 | 22 | | SECTION 2. Section 12.114, Education Code, is amended by |
|---|
| 23 | 23 | | adding Subsection (c) to read as follows: |
|---|
| 24 | 24 | | (c) Before the commissioner may approve a charter revision |
|---|
| 25 | 25 | | request filed wholly or partly to request approval to move the |
|---|
| 26 | 26 | | location of an open-enrollment charter school out of the |
|---|
| 27 | 27 | | geographical area described in the school's charter or to add an |
|---|
| 28 | 28 | | additional school campus at a location that is not within the |
|---|
| 29 | 29 | | geographical area described in the school's charter, the agency |
|---|
| 30 | 30 | | shall hold a public hearing in the geographical area in which the |
|---|
| 31 | 31 | | charter holder proposes to operate the school. |
|---|
| 32 | 32 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 33 | 33 | | to an open-enrollment charter school charter application or request |
|---|
| 34 | 34 | | for a charter revision, as applicable, filed on or after the |
|---|
| 35 | 35 | | effective date of this Act. A charter application or request for a |
|---|
| 36 | 36 | | charter revision, as applicable, filed before the effective date of |
|---|
| 37 | 37 | | this Act is governed by the law in effect on the date the |
|---|
| 38 | 38 | | application or request for a revision was filed, and that law is |
|---|
| 39 | 39 | | continued in effect for that purpose. |

| 40 | 40 | | SECTION 4. This Act takes effect September 1, 2011. |
