77 relating to requiring a public hearing in the geographical area
88 proposed for an open-enrollment charter school.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 12.110(c), Education Code, is amended to
1111 read as follows:
1212 (c) As part of the application procedure, the board:
1313 (1) to determine parental and community support for a
1414 charter for an open-enrollment charter school, shall hold a public
1515 hearing in the geographical area that, under Subsection (b) and
1616 Section 12.111(a)(14), is described in the application form; and
1717 (2) may require a petition supporting a charter for
1818 the [a] school signed by a specified number of parents or guardians
1919 of school-age children residing in the area [in which a school is
2020 proposed or may hold a public hearing to determine parental support
2121 for the school].
2222 SECTION 2. Section 12.114, Education Code, is amended by
2323 adding Subsection (c) to read as follows:
2424 (c) Before the commissioner may approve a charter revision
2525 request filed wholly or partly to request approval to move the
2626 location of an open-enrollment charter school out of the
2727 geographical area described in the school's charter or to add an
2828 additional school campus at a location that is not within the
2929 geographical area described in the school's charter, the agency
3030 shall hold a public hearing in the geographical area in which the
3131 charter holder proposes to operate the school.
3232 SECTION 3. The change in law made by this Act applies only
3333 to an open-enrollment charter school charter application or request
3434 for a charter revision, as applicable, filed on or after the
3535 effective date of this Act. A charter application or request for a
3636 charter revision, as applicable, filed before the effective date of
3737 this Act is governed by the law in effect on the date the
3838 application or request for a revision was filed, and that law is
3939 continued in effect for that purpose.
4040 SECTION 4. This Act takes effect September 1, 2011.
