A BILL TO BE ENTITLED
AN ACT
relating to the annual reporting of groundwater use in activities
related to the exploration or drilling for or production of oil or
gas by owners or operators of oil and gas wells.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter E, Chapter 91, Natural Resources
Code, is amended by adding Section 91.1421 to read as follows:
Sec. 91.1421. ANNUAL REPORT OF GROUNDWATER USE. (a) In
this section, "groundwater" has the meaning assigned by Section
36.001, Water Code.
(b) An owner or operator who is engaged in the exploration
or drilling for or production of oil or gas shall:
(1) maintain an accounting of the amount of
groundwater used by the owner or operator in the exploration or
drilling for or production of oil or gas; and
(2) submit to the commission, the Texas Commission on
Environmental Quality, and the Texas Water Development Board an
annual report of the amount of groundwater used by the owner or
operator in the exploration or drilling for or production of oil or
gas in the preceding year.
SECTION 2. This Act takes effect September 1, 2011.
