| 11 | 11 | | relating to vehicles used for the purpose of participating in |

| 12 | 12 | | equine activities or attending livestock shows. |

| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 502.163(b), Transportation Code, is |
|---|
| 15 | 15 | | amended to read as follows: |
|---|
| 16 | 16 | | (b) A commercial motor vehicle may be registered under this |
|---|
| 17 | 17 | | section despite its use for transporting without charge the owner |
|---|
| 18 | 18 | | or a member of the owner's family: |
|---|
| 19 | 19 | | (1) to attend church or school; |
|---|
| 20 | 20 | | (2) to visit a doctor for medical treatment or |
|---|
| 21 | 21 | | supplies; [or] |
|---|
| 22 | 22 | | (3) for other necessities of the home or family; or |
|---|
| 23 | 23 | | (4) for the purpose of participating in equine |
|---|
| 24 | 24 | | activities or attending livestock shows, as defined by Section |
|---|
| 25 | 25 | | 87.001, Civil Practice and Remedies Code. |
|---|
| 26 | 26 | | SECTION 2. Section 504.504(b), Transportation Code, is |
|---|
| 27 | 27 | | amended to read as follows: |
|---|
| 28 | 28 | | (b) An owner is not required to register a vehicle that is |
|---|
| 29 | 29 | | used only temporarily on the highways if the vehicle is: |
|---|
| 30 | 30 | | (1) a farm trailer or farm semitrailer with a gross |
|---|
| 31 | 31 | | weight of more than 4,000 pounds but not more than 34,000 pounds |
|---|
| 32 | 32 | | that is used exclusively [to transport]: |
|---|
| 33 | 33 | | (A) to transport seasonally harvested |
|---|
| 34 | 34 | | agricultural products or livestock from the place of production to |
|---|
| 35 | 35 | | the place of processing, market, or storage; [or] |
|---|
| 36 | 36 | | (B) to transport farm supplies from the place of |
|---|
| 37 | 37 | | loading to the farm; or |
|---|
| 38 | 38 | | (C) for the purpose of participating in equine |
|---|
| 39 | 39 | | activities or attending livestock shows, as defined by Section |
|---|
| 40 | 40 | | 87.001, Civil Practice and Remedies Code; |
|---|
| 41 | 41 | | (2) machinery used exclusively for the purpose of |
|---|
| 42 | 42 | | drilling water wells; or |
|---|
| 43 | 43 | | (3) construction machinery that is not designed to |
|---|
| 44 | 44 | | transport persons or property on a public highway. |
|---|
| 45 | 45 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 46 | 46 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 47 | 47 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 48 | 48 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 49 | 49 | | Act takes effect September 1, 2011. |
