99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to vehicles used for the purpose of participating in
1212 equine activities or attending livestock shows.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 502.163(b), Transportation Code, is
1515 amended to read as follows:
1616 (b) A commercial motor vehicle may be registered under this
1717 section despite its use for transporting without charge the owner
1818 or a member of the owner's family:
1919 (1) to attend church or school;
2020 (2) to visit a doctor for medical treatment or
2121 supplies; [or]
2222 (3) for other necessities of the home or family; or
2323 (4) for the purpose of participating in equine
2424 activities or attending livestock shows, as defined by Section
2525 87.001, Civil Practice and Remedies Code.
2626 SECTION 2. Section 504.504(b), Transportation Code, is
2727 amended to read as follows:
2828 (b) An owner is not required to register a vehicle that is
2929 used only temporarily on the highways if the vehicle is:
3030 (1) a farm trailer or farm semitrailer with a gross
3131 weight of more than 4,000 pounds but not more than 34,000 pounds
3232 that is used exclusively [to transport]:
3333 (A) to transport seasonally harvested
3434 agricultural products or livestock from the place of production to
3535 the place of processing, market, or storage; [or]
3636 (B) to transport farm supplies from the place of
3737 loading to the farm; or
3838 (C) for the purpose of participating in equine
3939 activities or attending livestock shows, as defined by Section
4040 87.001, Civil Practice and Remedies Code;
4141 (2) machinery used exclusively for the purpose of
4242 drilling water wells; or
4343 (3) construction machinery that is not designed to
4444 transport persons or property on a public highway.
4545 SECTION 3. This Act takes effect immediately if it receives
4646 a vote of two-thirds of all the members elected to each house, as
4747 provided by Section 39, Article III, Texas Constitution. If this
4848 Act does not receive the vote necessary for immediate effect, this
4949 Act takes effect September 1, 2011.
