1010 relating to the confidentiality of certain communications and
1111 records made or collected in reference to certain sexual assault
1212 survivors.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Article 56.065, Code of Criminal Procedure, is
1515 amended by adding Subsection (j) to read as follows:
1616 (j) A communication or record that contains identifying
1717 information regarding a person who receives a forensic medical
1818 examination under this article and that is created by, provided to,
1919 or in the control or possession of the department is confidential
2020 for purposes of Section 552.101, Government Code. In this
2121 subsection, "identifying information" includes:
2222 (1) information revealing the identity, personal
2323 history, or background of the person; or
2424 (2) information concerning the victimization of the
2525 person.
2626 SECTION 2. This Act takes effect immediately if it receives
2727 a vote of two-thirds of all the members elected to each house, as
2828 provided by Section 39, Article III, Texas Constitution. If this
2929 Act does not receive the vote necessary for immediate effect, this
3030 Act takes effect September 1, 2011.
