BILL ANALYSIS H.B. 2978 By: Hunter County Affairs Committee Report (Unamended) BACKGROUND AND PURPOSE Currently, certain entities are excluded from a requirement to hold an open meeting to deliberate specified pricing or financial planning information or information relating to a proposed new service or product line. However, this exclusion is not applicable to a county hospital or a county hospital authority. H.B. 2978 seeks to address this issue by providing county hospitals and county hospital authorities with the same exclusion. RULEMAKING AUTHORITY It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS H.B. 2978 amends the Government Code to include the governing boards of a county hospital and a county hospital authority among the governing boards not required to conduct an open meeting to deliberate pricing or financial planning information relating to a bid or negotiation for the arrangement or provision of services or product lines to another person if disclosure of the information would give advantage to competitors of the hospital, hospital district, or nonprofit health maintenance organization or to deliberate information relating to a proposed new service or product line of the hospital, hospital district, or nonprofit health maintenance organization before publicly announcing the service or product line.
