9	9	AN ACT
10	10	relating to the applicability of open meetings requirements to
11	11	certain meetings of the governing board of a county hospital or
12	12	county hospital authority.
13	13	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	14	SECTION 1. Section 551.085(a), Government Code, is amended
15	15	to read as follows:
16	16	(a) This chapter does not require the governing board of a
17	17	municipal hospital, municipal hospital authority, county hospital,
18	18	county hospital authority, hospital district created under general
19	19	or special law, or nonprofit health maintenance organization
20	20	created under Section 534.101, Health and Safety Code, to conduct
21	21	an open meeting to deliberate:
22	22	(1) pricing or financial planning information
23	23	relating to a bid or negotiation for the arrangement or provision of
24	24	services or product lines to another person if disclosure of the
25	25	information would give advantage to competitors of the hospital,
26	26	hospital district, or nonprofit health maintenance organization;
27	27	or
28	28	(2) information relating to a proposed new service or
29	29	product line of the hospital, hospital district, or nonprofit
30	30	health maintenance organization before publicly announcing the
31	31	service or product line.
32	32	SECTION 2. This Act takes effect September 1, 2011.
