77 relating to the grievance procedure for firefighters and police
88 officers in certain municipalities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 143.127(a), Local Government Code, is
1111 amended to read as follows:
1212 (a) Except as otherwise provided by this subsection, a fire
1313 fighter or police officer may file a grievance as provided by this
1414 subchapter that relates to any aspect of the fire fighter's or
1515 police officer's compensation, benefits, or conditions of
1616 employment not otherwise covered by an agreement created under
1717 Subchapter J or Chapter 174 [this chapter]. The fire fighter or
1818 police officer may not file a grievance relating to:
1919 (1) a disciplinary suspension, indefinite suspension,
2020 promotional pass over, or demotion or other action or decision for
2121 which a hearing, review, or appeal is otherwise provided by this
2222 chapter; or
2323 (2) an allegation of discrimination based, in whole or
2424 in part, on race, color, religion, sex, or national origin.
2525 SECTION 2. The change in law made by this Act to Section
2626 143.127(a), Local Government Code, applies only to a grievance
2727 filed on or after the effective date of this Act. A grievance filed
2828 before the effective date of this Act is governed by the law in
2929 effect on the date the grievance was filed, and the former law is
3030 continued in effect for that purpose.
3131 SECTION 3. This Act takes effect September 1, 2011.
