| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 49.273, Water Code, is amended by adding |
|---|
| 13 | 13 | | Subsections (n) and (o) to read as follows: |
|---|
| 14 | 14 | | (n) If the competitive sealed bidding requirement applies |
|---|
| 15 | 15 | | to a contract for goods or services, the contract must be awarded to |
|---|
| 16 | 16 | | the lowest responsible bidder or to the bidder who provides the |
|---|
| 17 | 17 | | goods or services at the best value for the district. |
|---|
| 18 | 18 | | (o) In determining the best value for the district, the |
|---|
| 19 | 19 | | board may consider: |
|---|
| 20 | 20 | | (1) the purchase price; |
|---|
| 21 | 21 | | (2) the reputation of the bidder and of the bidder's |
|---|
| 22 | 22 | | goods and services; |
|---|
| 23 | 23 | | (3) the quality of the bidder's goods or services; |
|---|
| 24 | 24 | | (4) the extent to which the goods or services meet the |
|---|
| 25 | 25 | | board's needs; |
|---|
| 26 | 26 | | (5) the bidder's past relationship with the board; |
|---|
| 27 | 27 | | (6) the impact on the ability of the board to comply |
|---|
| 28 | 28 | | with laws, rules, and policies of the board relating to |
|---|
| 29 | 29 | | historically underutilized or minority businesses, the board's |
|---|
| 30 | 30 | | small business development program, or another contracting program |
|---|
| 31 | 31 | | approved by the board, if any; |
|---|
| 32 | 32 | | (7) the total long-term cost to the board to acquire |
|---|
| 33 | 33 | | the bidder's goods or services; |
|---|
| 34 | 34 | | (8) the bidder's principal place of business, if, in |
|---|
| 35 | 35 | | the board's exclusive judgment, the bid offers the most advantage |
|---|
| 36 | 36 | | and would result in the best and most economical completion of the |
|---|
| 37 | 37 | | board's proposed plants, works, facilities, or improvements; and |
|---|
| 38 | 38 | | (9) any other relevant factor listed in the request |
|---|
| 39 | 39 | | for bids or proposals. |

| 40 | 40 | | SECTION 2. This Act takes effect September 1, 2011. |
