99 relating to contract award considerations by certain conservation
1010 and reclamation districts.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 49.273, Water Code, is amended by adding
1313 Subsections (n) and (o) to read as follows:
1414 (n) If the competitive sealed bidding requirement applies
1515 to a contract for goods or services, the contract must be awarded to
1616 the lowest responsible bidder or to the bidder who provides the
1717 goods or services at the best value for the district.
1818 (o) In determining the best value for the district, the
1919 board may consider:
2020 (1) the purchase price;
2121 (2) the reputation of the bidder and of the bidder's
2222 goods and services;
2323 (3) the quality of the bidder's goods or services;
2424 (4) the extent to which the goods or services meet the
2525 board's needs;
2626 (5) the bidder's past relationship with the board;
2727 (6) the impact on the ability of the board to comply
2828 with laws, rules, and policies of the board relating to
2929 historically underutilized or minority businesses, the board's
3030 small business development program, or another contracting program
3131 approved by the board, if any;
3232 (7) the total long-term cost to the board to acquire
3333 the bidder's goods or services;
3434 (8) the bidder's principal place of business, if, in
3535 the board's exclusive judgment, the bid offers the most advantage
3636 and would result in the best and most economical completion of the
3737 board's proposed plants, works, facilities, or improvements; and
3838 (9) any other relevant factor listed in the request
3939 for bids or proposals.
4040 SECTION 2. This Act takes effect September 1, 2011.
