99 relating to commissions paid to public insurance adjusters.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 4102.104, Insurance Code, is amended by
1212 amending Subsection (a) and adding Subsections (f) and (g) to read
1313 as follows:
1414 (a) Except as provided by Subsection (b), a license holder
1515 may receive a commission for service provided under this chapter
1616 consisting of an hourly fee, a flat rate, a percentage of the total
1717 amount paid by an insurer to resolve a claim, or another method of
1818 compensation. Subject to Subsection (g), the [The] total
1919 commission received, excluding sales tax, may not exceed 10 percent
2020 of the amount of the insurance settlement on the claim.
2121 (f) A license holder may be paid a commission that is based,
2222 in part, on an amount paid by, or a negotiable instrument issued by,
2323 the insurer to an insured before the effective date of the public
2424 insurance adjuster's contract with the insured, if the insurer
2525 obtains the insured's written consent to the payment.
2626 (g) A commission paid under Subsection (f) may not exceed
2727 the lesser of:
2828 (1) 25 percent of the difference between the amount
2929 the public insurance adjuster obtained to resolve a claim on behalf
3030 of the insured and the amount the insurer initially offered to pay
3131 the insured to resolve the claim; or
3232 (2) 10 percent of the total amount paid by the insurer
3333 to resolve a claim under Subsection (a).
3434 SECTION 2. The changes in law made to Section 4102.104,
3535 Insurance Code, by this Act apply only to a commission paid on or
3636 after the effective date of this Act. A commission paid before the
3737 effective date of this Act is governed by the law in effect
3838 immediately before the effective date of this Act, and that law is
3939 continued in effect for that purpose.
4040 SECTION 3. This Act takes effect September 1, 2011.
