By: Hancock H.B. No. 3164 A BILL TO BE ENTITLED AN ACT relating to contracts between advanced practice registered nurses and health maintenance organizations, preferred provider benefit plans or other insurers. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter I, Chapter 843, Insurance Code, is amended by adding Section 843.3116 to read as follows: Sec. 843.3116. CONTRACTS WITH ADVANCED PRACTICE REGISTERED NURSES. An advanced practice registered nurse whose services are provided within the limits of their knowledge, skills and training pursuant to a contract with a health maintenance organization is not subject to the requirements in Chapter 157 of the Occupations Code. SECTION 2. Chapter 1301, Insurance Code, is amended by adding Section 1301.070 to read as follows: Section 1301.070 CONTRACTS WITH ADVANCED PRACTICE REGISTERED NURSES. An advanced practice registered nurse whose services are provided within the limits of their knowledge, skills and training pursuant to a contract with a preferred provider is not subject to the requirements in Chapter 157 of the Occupations Code. SECTION 3. Section 1451.106, Subchapter E, Chapter 1451, Insurance Code, is amended to read as follows: Sec. 1451.106. SELECTION OF ADVANCED PRACTICE NURSE. An insured may select an advanced practice nurse to provide the services scheduled in the health insurance policy that are within the scope of the nurse's license. An advanced practice registered nurse whose services are provided within the limits of their knowledge, skills and training is not subject to the requirements in Chapter 157 of the Occupations Code. SECTION 4. Sections 843.3116 and 1451.2066, Insurance Code, as added by this Act, apply only to a contract entered into or renewed on or after the effective date of this Act. A contract entered into or renewed before the effective date of this Act is governed by the law in effect immediately before the effective date of this Act, and that law is continued in effect for that purpose. SECTION 5. This Act takes effect September 1, 2011.
