 A BILL TO BE ENTITLED
 AN ACT
 relating to certain fees charged by retail electric providers and
 aggregators.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Subchapter C, Chapter 39, Utilities Code, is
 amended by adding Section 39.114 to read as follows:
 Sec. 39.114.  CERTAIN FEES PROHIBITED. A retail electric
 provider or aggregator may not charge a residential customer a fee
 for consuming less than a minimum electricity consumption amount
 set by the provider or aggregator.
 SECTION 2.  This Act takes effect September 1, 2011.
