A BILL TO BE ENTITLED
AN ACT
relating to the provision for notice and comment for pollution
control projects.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 382, Subchapter C, Health and Safety
Code, is amended by adding Section 382.0568 to read as follows:
Section 382.0568 (a) The commission shall provide an
opportunity for a public hearing and the submission of public
comment and send notice of a decision on an application for a permit
amendment application required under this chapter for an electric
generating facility that is seeking such authorization to comply
with Section 112 of the federal Clean Air Act Amendments of 1990
(Pub.L. No. 101-549) in the same manner as provided by Section
382.0561.
(b) A person affected by a decision of the commission to
issue or deny a permit under this Section may move for rehearing and
is entitled to judicial review under Section 382.032.
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2011.
