66 AN ACT
77 relating to the operation and regulation of 24-number bingo games.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 2001.002, Occupations Code, is amended
1010 by amending Subdivisions (5) and (8-a) and adding Subdivisions
1111 (8-b) and (29) to read as follows:
1212 (5) "Bingo equipment" means equipment used, made, or
1313 sold for the purpose of use in bingo. The term:
1414 (A) includes:
1515 (i) a machine or other device from which
1616 balls or other items are withdrawn to determine the letters and
1717 numbers or other symbols to be called;
1818 (ii) an electronic or mechanical
1919 card-minding [cardminding] device;
2020 (iii) a pull-tab dispenser;
2121 (iv) a bingo card;
2222 (v) a bingo ball; and
2323 (vi) any other device commonly used in the
2424 direct operation of a bingo game; and
2525 (B) does not include:
2626 (i) a bingo game set commonly manufactured
2727 and sold as a child's game for a retail price of $20 or less unless
2828 the set or a part of the set is used in bingo subject to regulation
2929 under this chapter; or
3030 (ii) a commonly available component part of
3131 bingo equipment such as a light bulb or fuse.
3232 (8-a) "Credit value" means the value of money or other
3333 consideration accounted for by a card-minding device that:
3434 (A) includes the prize money won and the initial
3535 credits purchased from a point-of-sale station that is not the
3636 card-minding device for deposit in a person's bingo account; and
3737 (B) may be used by the person for the purchase of
3838 bingo cards or pull-tab bingo tickets.
3939 (8-b) "Crime of moral turpitude" means:
4040 (A) a felony;
4141 (B) a gambling offense;
4242 (C) criminal fraud;
4343 (D) forgery;
4444 (E) theft;
4545 (F) an offense that involves filing false
4646 information with a governmental agency; or
4747 (G) any offense that:
4848 (i) is classified in this state as a Class A
4949 misdemeanor; and
5050 (ii) puts the honesty and integrity of the
5151 individual who committed the offense in question.
5252 (29) "24-number bingo" means a form of bingo in which
5353 prizes are awarded when designated numbers or symbols conform to 24
5454 randomly preselected numbers or symbols.
5555 SECTION 2. Section 2001.409, Occupations Code, is amended
5656 by adding Subsection (b) to read as follows:
5757 (b) A person playing 24-number bingo may use a card-minding
5858 device:
5959 (1) to display the person's available credit value
6060 associated with the person's bingo account; and
6161 (2) to perform transactions using the credit value.
6262 SECTION 3. Section 2001.419, Occupations Code, is amended
6363 by adding Subsection (f) to read as follows:
6464 (f) A licensed authorized organization may conduct
6565 24-number bingo at the same time that the organization conducts
6666 other forms of bingo.
6767 SECTION 4. Section 2001.420(b), Occupations Code, is
6868 amended to read as follows:
6969 (b) A [For bingo games other than pull-tab bingo, a] person
7070 may not offer or award on a single bingo occasion prizes with an
7171 aggregate value of more than $2,500 for all bingo games other than:
7272 (1) pull-tab bingo; or
7373 (2) 24-number bingo games that award individual prizes
7474 of $25 or less.
7575 SECTION 5. As soon as practicable after the effective date
7676 of this Act, but not later than December 1, 2011, the Texas Lottery
7777 Commission shall adopt rules necessary to implement the changes in
7878 law made by this Act to Chapter 2001, Occupations Code.
7979 SECTION 6. This Act takes effect immediately if it receives
8080 a vote of two-thirds of all the members elected to each house, as
8181 provided by Section 39, Article III, Texas Constitution. If this
8282 Act does not receive the vote necessary for immediate effect, this
8383 Act takes effect September 1, 2011.
