|---|
| 7 | 7 | | relating to the operation and regulation of 24-number bingo games. |
|---|
| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 2001.002, Occupations Code, is amended |
|---|
| 10 | 10 | | by amending Subdivisions (5) and (8-a) and adding Subdivisions |
|---|
| 11 | 11 | | (8-b) and (29) to read as follows: |
|---|
| 12 | 12 | | (5) "Bingo equipment" means equipment used, made, or |
|---|
| 13 | 13 | | sold for the purpose of use in bingo. The term: |
|---|
| 14 | 14 | | (A) includes: |
|---|
| 15 | 15 | | (i) a machine or other device from which |
|---|
| 16 | 16 | | balls or other items are withdrawn to determine the letters and |
|---|
| 17 | 17 | | numbers or other symbols to be called; |
|---|
| 18 | 18 | | (ii) an electronic or mechanical |
|---|
| 19 | 19 | | card-minding [cardminding] device; |
|---|
| 20 | 20 | | (iii) a pull-tab dispenser; |
|---|
| 21 | 21 | | (iv) a bingo card; |
|---|
| 22 | 22 | | (v) a bingo ball; and |
|---|
| 23 | 23 | | (vi) any other device commonly used in the |
|---|
| 24 | 24 | | direct operation of a bingo game; and |
|---|
| 25 | 25 | | (B) does not include: |
|---|
| 26 | 26 | | (i) a bingo game set commonly manufactured |
|---|
| 27 | 27 | | and sold as a child's game for a retail price of $20 or less unless |
|---|
| 28 | 28 | | the set or a part of the set is used in bingo subject to regulation |
|---|
| 29 | 29 | | under this chapter; or |
|---|
| 30 | 30 | | (ii) a commonly available component part of |
|---|
| 31 | 31 | | bingo equipment such as a light bulb or fuse. |
|---|
| 32 | 32 | | (8-a) "Credit value" means the value of money or other |
|---|
| 33 | 33 | | consideration accounted for by a card-minding device that: |
|---|
| 34 | 34 | | (A) includes the prize money won and the initial |
|---|
| 35 | 35 | | credits purchased from a point-of-sale station that is not the |
|---|
| 36 | 36 | | card-minding device for deposit in a person's bingo account; and |
|---|
| 37 | 37 | | (B) may be used by the person for the purchase of |
|---|
| 38 | 38 | | bingo cards or pull-tab bingo tickets. |
|---|
| 39 | 39 | | (8-b) "Crime of moral turpitude" means: |
|---|
| 40 | 40 | | (A) a felony; |
|---|
| 41 | 41 | | (B) a gambling offense; |
|---|
| 42 | 42 | | (C) criminal fraud; |
|---|
| 43 | 43 | | (D) forgery; |
|---|
| 44 | 44 | | (E) theft; |
|---|
| 45 | 45 | | (F) an offense that involves filing false |
|---|
| 46 | 46 | | information with a governmental agency; or |
|---|
| 47 | 47 | | (G) any offense that: |
|---|
| 48 | 48 | | (i) is classified in this state as a Class A |
|---|
| 49 | 49 | | misdemeanor; and |
|---|
| 50 | 50 | | (ii) puts the honesty and integrity of the |
|---|
| 51 | 51 | | individual who committed the offense in question. |
|---|
| 52 | 52 | | (29) "24-number bingo" means a form of bingo in which |
|---|
| 53 | 53 | | prizes are awarded when designated numbers or symbols conform to 24 |
|---|
| 54 | 54 | | randomly preselected numbers or symbols. |
|---|
| 55 | 55 | | SECTION 2. Section 2001.409, Occupations Code, is amended |
|---|
| 56 | 56 | | by adding Subsection (b) to read as follows: |
|---|
| 57 | 57 | | (b) A person playing 24-number bingo may use a card-minding |
|---|
| 58 | 58 | | device: |
|---|
| 59 | 59 | | (1) to display the person's available credit value |
|---|
| 60 | 60 | | associated with the person's bingo account; and |
|---|
| 61 | 61 | | (2) to perform transactions using the credit value. |
|---|
| 62 | 62 | | SECTION 3. Section 2001.419, Occupations Code, is amended |
|---|
| 63 | 63 | | by adding Subsection (f) to read as follows: |
|---|
| 64 | 64 | | (f) A licensed authorized organization may conduct |
|---|
| 65 | 65 | | 24-number bingo at the same time that the organization conducts |
|---|
| 66 | 66 | | other forms of bingo. |
|---|
| 67 | 67 | | SECTION 4. Section 2001.420(b), Occupations Code, is |
|---|
| 68 | 68 | | amended to read as follows: |
|---|
| 69 | 69 | | (b) A [For bingo games other than pull-tab bingo, a] person |
|---|
| 70 | 70 | | may not offer or award on a single bingo occasion prizes with an |
|---|
| 71 | 71 | | aggregate value of more than $2,500 for all bingo games other than: |
|---|
| 72 | 72 | | (1) pull-tab bingo; or |
|---|
| 73 | 73 | | (2) 24-number bingo games that award individual prizes |
|---|
| 74 | 74 | | of $25 or less. |
|---|
| 75 | 75 | | SECTION 5. As soon as practicable after the effective date |
|---|
| 76 | 76 | | of this Act, but not later than December 1, 2011, the Texas Lottery |
|---|
| 77 | 77 | | Commission shall adopt rules necessary to implement the changes in |
|---|
| 78 | 78 | | law made by this Act to Chapter 2001, Occupations Code. |
|---|
| 79 | 79 | | SECTION 6. This Act takes effect immediately if it receives |
|---|
| 80 | 80 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 81 | 81 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 82 | 82 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 83 | 83 | | Act takes effect September 1, 2011. |
