99 AN ACT
1010 relating to license renewals by the Texas Department of Licensing
1111 and Regulation.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Sections 51.401(c) and (d), Occupations Code,
1414 are amended to read as follows:
1515 (c) A person whose license has been expired for more than 90
1616 days but less than 18 months [one year] may renew the license by
1717 paying to the department a renewal fee that is equal to two times
1818 the normally required renewal fee. On approval by the executive
1919 director, a person whose license has been expired for at least 18
2020 months but less than three years may renew the license by paying to
2121 the department a renewal fee equal to two times the normally
2222 required renewal fee.
2323 (d) Except as provided by Subsection (c), a [A] person whose
2424 license has been expired for 18 months [one year] or more may not
2525 renew the license. The person may obtain a new license by complying
2626 with the requirements and procedures, including the examination
2727 requirements, for obtaining an original license.
2828 SECTION 2. The changes in law made by this Act apply only to
2929 an application for the renewal of a license that is filed with the
3030 Texas Department of Licensing and Regulation on or after the
3131 effective date of this Act. An application for the renewal of a
3232 license that is filed before the effective date of this Act is
3333 governed by the law in effect on the date the application was filed,
3434 and the former law is continued in effect for that purpose.
3535 SECTION 3. This Act takes effect September 1, 2011.
