99 relating to a pilot project to establish a comprehensive access
1010 point for long-term services and supports provided to older persons
1111 and persons with physical disabilities.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1414 amended by adding Section 531.0525 to read as follows:
1515 Sec. 531.0525. PILOT PROJECT TO ESTABLISH COMPREHENSIVE
1616 ACCESS POINT FOR LONG-TERM SERVICES AND SUPPORTS. (a) In this
1717 section:
1818 (1) "Aging and disability resource center" means a
1919 center established under the Aging and Disability Resource Center
2020 initiative funded in part by the federal Administration on Aging
2121 and the Centers for Medicare and Medicaid Services.
2222 (2) "Colocated long-term services and supports staff
2323 members" means:
2424 (A) long-term services and supports staff
2525 members who are located in the same physical office; or
2626 (B) long-term services and supports staff
2727 members who are not located in the same physical office but who work
2828 collaboratively through the use of the telephone or other
2929 technologies.
3030 (3) "Department of Aging and Disability Services staff
3131 members" includes community services staff members of the
3232 Department of Aging and Disability Services.
3333 (4) "Long-term services and supports" means long-term
3434 assistance or care provided to older persons and persons with
3535 physical disabilities through the Medicaid program or other
3636 programs. The term includes assistance or care provided through
3737 the following programs:
3838 (A) the primary home care program;
3939 (B) the community attendant services program;
4040 (C) the community-based alternatives program;
4141 (D) the day activity and health services program;
4242 (E) the promoting independence program;
4343 (F) a program funded through the Older Americans
4444 Act of 1965 (42 U.S.C. Section 3001 et seq.);
4545 (G) a community care program funded through Title
4646 XX of the federal Social Security Act (42 U.S.C. Section 301 et
4747 seq.);
4848 (H) the in-home and family support program; and
4949 (I) a nursing facility program.
5050 (5) "Long-term services and supports staff" means:
5151 (A) one or more of the commission's Medicaid
5252 eligibility determination staff members;
5353 (B) one or more Department of Aging and
5454 Disability Services staff members; and
5555 (C) one or more area agency on aging staff
5656 members.
5757 (6) "Pilot project site" means a location in an area
5858 served by the pilot project established under this section where
5959 colocated long-term services and supports staff members work
6060 collaboratively to provide information and tentatively assess
6161 functional and financial eligibility to initiate long-term
6262 services and supports.
6363 (7) "Tentative assessment of functional and financial
6464 eligibility" means an expedited preliminary screening of an
6565 applicant to determine Medicaid eligibility with the goal of
6666 initiating services within seven business days. The tentative
6767 assessment does not guarantee state payment for services.
6868 (b) Subject to availability of funds appropriated by the
6969 legislature for this purpose, the commission shall develop and
7070 implement a pilot project to establish a comprehensive access point
7171 system for long-term services and supports in which colocated
7272 long-term services and supports staff members work in collaboration
7373 to provide all necessary services in connection with long-term
7474 services and supports from the intake process to the start of
7575 service delivery. The pilot project must require that, at a
7676 minimum, the staff members work collaboratively to:
7777 (1) inform and educate older persons, persons with
7878 physical disabilities, and their family members and other
7979 caregivers about long-term services and supports for which they may
8080 qualify;
8181 (2) screen older persons and persons with physical
8282 disabilities requesting long-term services and supports;
8383 (3) provide a tentative assessment of functional and
8484 financial eligibility for older persons and persons with physical
8585 disabilities requesting long-term services and supports for which
8686 there are no interest lists; and
8787 (4) make final determinations of eligibility for
8888 long-term services and supports.
8989 (c) In developing and implementing the pilot project, the
9090 commission shall ensure that:
9191 (1) the pilot project site has colocated long-term
9292 services and supports staff members who are located in the same
9393 physical office;
9494 (2) the pilot project site serves as a comprehensive
9595 access point for older persons and persons with physical
9696 disabilities to obtain information about long-term services and
9797 supports for which they may qualify and access long-term services
9898 and supports in the site's service area;
9999 (3) the pilot project site is designed and operated in
100100 accordance with best practices adopted by the executive
101101 commissioner after the commission reviews best practices for
102102 similar initiatives in other states and professional policy-based
103103 research describing best practices for successful initiatives;
104104 (4) the colocated long-term services and supports
105105 staff members supporting the pilot project site include:
106106 (A) one full-time commission staff member who
107107 determines eligibility for the Medicaid program and who:
108108 (i) has full access to the Texas Integrated
109109 Eligibility Redesign System (TIERS);
110110 (ii) has previously made Medicaid long-term
111111 care eligibility determinations; and
112112 (iii) is dedicated primarily to making
113113 eligibility determinations for incoming clients at the site;
114114 (B) sufficient Department of Aging and
115115 Disability Services staff members to carry out the tentative
116116 functional and financial eligibility and screening functions at the
117117 site;
118118 (C) sufficient area agency on aging staff members
119119 to:
120120 (i) assist with the performance of
121121 screening functions and service coordination for services funded
122122 under the Older Americans Act of 1965 (42 U.S.C. Section 3001 et
123123 seq.), such as meals programs; and
124124 (ii) identify other locally funded and
125125 supported services that will enable older persons and persons with
126126 physical disabilities to continue to reside in the community to the
127127 extent reasonable; and
128128 (D) any available staff members from local
129129 service agencies; and
130130 (5) the colocated long-term services and supports
131131 staff members of the pilot project site:
132132 (A) process intakes for long-term services and
133133 supports in person or by telephone or through the Internet;
134134 (B) use a standardized screening tool to
135135 tentatively assess both functional and financial eligibility with
136136 the goal of initiating services within seven business days;
137137 (C) closely coordinate with local hospital
138138 discharge planners and staff members of extended rehabilitation
139139 units of local hospitals and nursing homes; and
140140 (D) inform persons about community-based
141141 services available in the area served by the pilot project.
142142 (d) The pilot project must be implemented in a single county
143143 or a multicounty area, as determined by the commission. The pilot
144144 project site must be located within an aging and disability
145145 resource center service area. If the commission finds that there is
146146 no aging and disability resource center that is willing or able to
147147 accommodate a pilot project site on the date the pilot project is to
148148 be implemented, the pilot project site may be located at another
149149 appropriate location.
150150 (e) Not later than January 31, 2013, the commission shall
151151 submit a report concerning the pilot project to the presiding
152152 officers of the standing committees of the senate and house of
153153 representatives having primary jurisdiction over health and human
154154 services. The report must:
155155 (1) contain an evaluation of the operation of the
156156 pilot project;
157157 (2) contain an evaluation of the pilot project's
158158 benefits for persons who received services;
159159 (3) contain a calculation of the costs and cost
160160 savings that can be attributed to implementation of the pilot
161161 project;
162162 (4) include a recommendation regarding adopting
163163 improved policies and procedures concerning long-term services and
164164 supports with statewide applicability, as determined from
165165 information obtained in operating the pilot project;
166166 (5) include a recommendation regarding the
167167 feasibility of expanding the pilot project to other areas of this
168168 state or statewide; and
169169 (6) contain the perspectives of service providers
170170 participating in the pilot project.
171171 (f) This section expires September 1, 2015.
172172 SECTION 2. Not later than December 31, 2011, the Health and
173173 Human Services Commission shall ensure that the pilot project site
174174 is in operation under the pilot project required by Section
175175 531.0525, Government Code, as added by this Act.
176176 SECTION 3. If before implementing any provision of this Act
177177 a state agency determines that a waiver or authorization from a
178178 federal agency is necessary for implementation of that provision,
179179 the agency affected by the provision shall request the waiver or
180180 authorization and may delay implementing that provision until the
181181 waiver or authorization is granted.
182182 SECTION 4. This Act takes effect immediately if it receives
183183 a vote of two-thirds of all the members elected to each house, as
184184 provided by Section 39, Article III, Texas Constitution. If this
185185 Act does not receive the vote necessary for immediate effect, this
186186 Act takes effect September 1, 2011.
