| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 334, Local Government |
|---|
| 12 | 12 | | Code, is amended by adding Section 334.0083 to read as follows: |
|---|
| 13 | 13 | | Sec. 334.0083. VENUE PROJECTS IN CERTAIN COUNTIES. (a) In |
|---|
| 14 | 14 | | this section, "venue" has the meaning assigned by Section 334.001 |
|---|
| 15 | 15 | | and includes a tourism development project such as a park, |
|---|
| 16 | 16 | | aquarium, birding center, bird viewing site, history center, art |
|---|
| 17 | 17 | | center, nature center, nature trail, museum, or water-related |
|---|
| 18 | 18 | | project that creates or enhances an activity involving water sports |
|---|
| 19 | 19 | | or fishing. |
|---|
| 20 | 20 | | (b) A county with a population of 40,000 or less in which at |
|---|
| 21 | 21 | | least one state park and one national wildlife refuge are located |
|---|
| 22 | 22 | | may plan, acquire, establish, develop, construct, or renovate a |
|---|
| 23 | 23 | | venue as a venue project under this chapter. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2011. |
