 A BILL TO BE ENTITLED
 AN ACT
 relating to state contribution to the cost of certain dependents'
 participation in the group benefits program for state employees and
 their dependents.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 1551.310, Insurance Code, is amended to
 read as follows:
 Sec. 1551.310.  STATE CONTRIBUTION REQUIRED. (a) Subject to
 Subsection (b), the [The] state shall contribute to the cost of each
 participant's group coverages, including dependents' group
 coverages, the amounts appropriated for the coverages in the
 General Appropriations Act.
 (b)  The state may not contribute more than 90 percent of the
 amount that the state contributes for the group coverage of a
 dependent under Subsection (a) for a spouse who participates in the
 group benefits program in lieu of participating in another health
 benefit plan in which the spouse is eligible to participate,
 including a health benefit plan offered by the spouse's employer.
 SECTION 2.  The change in law made by this Act applies only
 to group coverage provided under Chapter 1551, Insurance Code, for
 a plan year beginning on or after September 1, 2011. A plan year
 that begins before that date is governed by the law as it existed
 immediately before the effective date of this Act, and that law is
 continued in effect for that purpose.
 SECTION 3.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2011.
