| 8 | 8 | | participation in the group benefits program for state employees and |
|---|
| 9 | 9 | | their dependents. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 1551.310, Insurance Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | Sec. 1551.310. STATE CONTRIBUTION REQUIRED. (a) Subject to |
|---|
| 14 | 14 | | Subsection (b), the [The] state shall contribute to the cost of each |
|---|
| 15 | 15 | | participant's group coverages, including dependents' group |
|---|
| 16 | 16 | | coverages, the amounts appropriated for the coverages in the |
|---|
| 17 | 17 | | General Appropriations Act. |
|---|
| 18 | 18 | | (b) The state may not contribute more than 90 percent of the |
|---|
| 19 | 19 | | amount that the state contributes for the group coverage of a |
|---|
| 20 | 20 | | dependent under Subsection (a) for a spouse who participates in the |
|---|
| 21 | 21 | | group benefits program in lieu of participating in another health |
|---|
| 22 | 22 | | benefit plan in which the spouse is eligible to participate, |
|---|
| 23 | 23 | | including a health benefit plan offered by the spouse's employer. |
|---|
| 24 | 24 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 25 | 25 | | to group coverage provided under Chapter 1551, Insurance Code, for |
|---|
| 26 | 26 | | a plan year beginning on or after September 1, 2011. A plan year |
|---|
| 27 | 27 | | that begins before that date is governed by the law as it existed |
|---|
| 28 | 28 | | immediately before the effective date of this Act, and that law is |
|---|
| 29 | 29 | | continued in effect for that purpose. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 31 | 31 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 32 | 32 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 33 | 33 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 34 | 34 | | Act takes effect September 1, 2011. |
