77 relating to state contribution to the cost of certain dependents'
88 participation in the group benefits program for state employees and
99 their dependents.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 1551.310, Insurance Code, is amended to
1212 read as follows:
1313 Sec. 1551.310. STATE CONTRIBUTION REQUIRED. (a) Subject to
1414 Subsection (b), the [The] state shall contribute to the cost of each
1515 participant's group coverages, including dependents' group
1616 coverages, the amounts appropriated for the coverages in the
1717 General Appropriations Act.
1818 (b) The state may not contribute more than 90 percent of the
1919 amount that the state contributes for the group coverage of a
2020 dependent under Subsection (a) for a spouse who participates in the
2121 group benefits program in lieu of participating in another health
2222 benefit plan in which the spouse is eligible to participate,
2323 including a health benefit plan offered by the spouse's employer.
2424 SECTION 2. The change in law made by this Act applies only
2525 to group coverage provided under Chapter 1551, Insurance Code, for
2626 a plan year beginning on or after September 1, 2011. A plan year
2727 that begins before that date is governed by the law as it existed
2828 immediately before the effective date of this Act, and that law is
2929 continued in effect for that purpose.
3030 SECTION 3. This Act takes effect immediately if it receives
3131 a vote of two-thirds of all the members elected to each house, as
3232 provided by Section 39, Article III, Texas Constitution. If this
3333 Act does not receive the vote necessary for immediate effect, this
3434 Act takes effect September 1, 2011.
