| 10 | 10 | | including pool-related electrical devices, under the Texas |
|---|
| 11 | 11 | | Electrical Safety and Licensing Act. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Sections 1305.002(12-a), (14), and (15), |
|---|
| 14 | 14 | | Occupations Code, are amended to read as follows: |
|---|
| 15 | 15 | | (12-a) "Residential appliance" means: |
|---|
| 16 | 16 | | (A) [a pool-related electrical device, or] |
|---|
| 17 | 17 | | equipment that: |
|---|
| 18 | 18 | | (i) [(A)] is installed as a unit in a |
|---|
| 19 | 19 | | single-family or multifamily dwelling that does not exceed four |
|---|
| 20 | 20 | | stories; |
|---|
| 21 | 21 | | (ii) [(B)] is directly connected to an |
|---|
| 22 | 22 | | electrical circuit; and |
|---|
| 23 | 23 | | (iii) [(C)] performs a specific function; |
|---|
| 24 | 24 | | or |
|---|
| 25 | 25 | | (B) a pool-related electrical device. |
|---|
| 26 | 26 | | (14) "Pool" means an outdoor or indoor structure that |
|---|
| 27 | 27 | | is located at a residential property, a business property, or a |
|---|
| 28 | 28 | | property owned by a municipality and that is intended for swimming |
|---|
| 29 | 29 | | or recreational bathing, including an inground structure, |
|---|
| 30 | 30 | | aboveground structure, hot tub, spa, portable spa, or non-portable |
|---|
| 31 | 31 | | wading pool. |
|---|
| 32 | 32 | | (15) "Pool-related electrical device" means equipment |
|---|
| 33 | 33 | | for a pool that: |
|---|
| 34 | 34 | | (A) is installed as a unit; |
|---|
| 35 | 35 | | (B) is directly connected to an electrical |
|---|
| 36 | 36 | | circuit; [and] |
|---|
| 37 | 37 | | (C) performs a specific function; and |
|---|
| 38 | 38 | | (D) uses single-phase power of 240 volts or less. |
|---|
| 39 | 39 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2011. |
