88 AN ACT
99 relating to the regulation of residential appliance installation,
1010 including pool-related electrical devices, under the Texas
1111 Electrical Safety and Licensing Act.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Sections 1305.002(12-a), (14), and (15),
1414 Occupations Code, are amended to read as follows:
1515 (12-a) "Residential appliance" means:
1616 (A) [a pool-related electrical device, or]
1717 equipment that:
1818 (i) [(A)] is installed as a unit in a
1919 single-family or multifamily dwelling that does not exceed four
2020 stories;
2121 (ii) [(B)] is directly connected to an
2222 electrical circuit; and
2323 (iii) [(C)] performs a specific function;
2424 or
2525 (B) a pool-related electrical device.
2626 (14) "Pool" means an outdoor or indoor structure that
2727 is located at a residential property, a business property, or a
2828 property owned by a municipality and that is intended for swimming
2929 or recreational bathing, including an inground structure,
3030 aboveground structure, hot tub, spa, portable spa, or non-portable
3131 wading pool.
3232 (15) "Pool-related electrical device" means equipment
3333 for a pool that:
3434 (A) is installed as a unit;
3535 (B) is directly connected to an electrical
3636 circuit; [and]
3737 (C) performs a specific function; and
3838 (D) uses single-phase power of 240 volts or less.
3939 SECTION 2. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2011.
