| 11 | 11 | SECTION 1. Chapter 370, Local Government Code, is amended | |
| 12 | 12 | by adding Section 370.005 to read as follows: | |
| 13 | 13 | Sec. 370.005. TRANSPORT OF FIREWORKS. A political | |
| 14 | 14 | subdivision may not prohibit or regulate the transport of fireworks | |
| 15 | 15 | in unopened and original packaging. | |
| 16 | 16 | SECTION 2. The heading to Chapter 370, Local Government | |
| 17 | 17 | Code, is amended to read as follows: | |
| 18 | 18 | CHAPTER 370. MISCELLANEOUS PROVISIONS RELATING TO [MUNICIPAL AND | |
| 19 | 19 | COUNTY] HEALTH AND PUBLIC SAFETY | |
| 20 | 20 | SECTION 3. This Act takes effect immediately if it receives | |
| 21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
| 22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
| 23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
| 24 | 24 | Act takes effect September 1, 2011. |
