77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter B, Chapter 222, Transportation Code,
99 is amended by adding Section 222.036 to read as follows:
1010 Sec. 222.036. FEDERAL-AID HIGHWAY PROGRAM OPT-OUT. (a) To
1111 the extent permitted by federal law, the governor may waive the
1212 state's right to receive money allocated under the federal-aid
1313 highway program and instead elect to receive the portion of the
1414 taxes appropriated to the Highway Trust Fund under Section 9503,
1515 Internal Revenue Code of 1986, that is attributable to highway
1616 users in the state, as calculated by the federal law permitting the
1717 waiver and election.
1818 (b) A waiver made under Subsection (a) must comply with all
1919 applicable federal requirements associated with the waiver.
2020 SECTION 2. (a) The comptroller shall conduct a study of
2121 how the state might benefit from withdrawing from the federal-aid
2222 highway program. The study conducted under this section must
2323 identify and analyze:
2424 (1) methods by which the state can withdraw from the
2525 federal-aid highway program, including methods that are not
2626 dependent on approval of the federal government; and
2727 (2) the costs and benefits associated with each
2828 method.
2929 (b) Not later than January 1, 2013, the comptroller shall
3030 submit to the legislature and the presiding officers of the
3131 standing committees of the senate and the house of representatives
3232 that have jurisdiction over issues related to transportation a
3333 report containing a summary of the study conducted under Subsection
3434 (a) of this section.
3535 SECTION 3. This Act takes effect September 1, 2011.
