14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

15 | 15 | | SECTION 1. Section 683.015(f), Transportation Code, is |
---|
16 | 16 | | amended to read as follows: |
---|
17 | 17 | | (f) A [county] law enforcement agency may use funds |
---|
18 | 18 | | [received from the sale of a motor vehicle abandoned as a result of |
---|
19 | 19 | | a vehicular pursuit involving the law enforcement agency and] |
---|
20 | 20 | | transferred under Subsection (d) to compensate property owners |
---|
21 | 21 | | whose property was damaged as a result of a [the] pursuit involving |
---|
22 | 22 | | the law enforcement agency, regardless of whether the agency would |
---|
23 | 23 | | be liable under Chapter 101, Civil Practice and Remedies Code. [A |
---|
24 | 24 | | payment for compensation under this subsection may not exceed any |
---|
25 | 25 | | of the following amounts: |
---|
26 | 26 | | [(1) the net proceeds received from the sale of the |
---|
27 | 27 | | motor vehicle abandoned as a result of the pursuit; |
---|
28 | 28 | | [(2) $1,000 per property owner, if more than one |
---|
29 | 29 | | property owner's property is damaged as a result of the pursuit; or |
---|
30 | 30 | | [(3) the amount of the property owner's insurance |
---|
31 | 31 | | deductible.] |
---|
32 | 32 | | SECTION 2. This Act takes effect immediately if it receives |
---|
33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
---|
34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
---|
36 | 36 | | Act takes effect September 1, 2011. |
