99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to the use of auction proceeds from the sale of abandoned
1212 motor vehicles, watercraft, or outboard motors to compensate
1313 certain property owners.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 683.015(f), Transportation Code, is
1616 amended to read as follows:
1717 (f) A [county] law enforcement agency may use funds
1818 [received from the sale of a motor vehicle abandoned as a result of
1919 a vehicular pursuit involving the law enforcement agency and]
2020 transferred under Subsection (d) to compensate property owners
2121 whose property was damaged as a result of a [the] pursuit involving
2222 the law enforcement agency, regardless of whether the agency would
2323 be liable under Chapter 101, Civil Practice and Remedies Code. [A
2424 payment for compensation under this subsection may not exceed any
2525 of the following amounts:
2626 [(1) the net proceeds received from the sale of the
2727 motor vehicle abandoned as a result of the pursuit;
2828 [(2) $1,000 per property owner, if more than one
2929 property owner's property is damaged as a result of the pursuit; or
3030 [(3) the amount of the property owner's insurance
3131 deductible.]
3232 SECTION 2. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2011.
