99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to certain criminal offenses committed in relation to a
1212 federal special investigator; providing criminal penalties.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 1.07(a), Penal Code, is amended by
1515 adding Subdivision (46-b) to read as follows:
1616 (46-b) "Federal special investigator" means a person
1717 described by Article 2.122, Code of Criminal Procedure.
1818 SECTION 2. The heading to Section 37.08, Penal Code, is
1919 amended to read as follows:
2020 Sec. 37.08. FALSE REPORT TO PEACE OFFICER, FEDERAL SPECIAL
2121 INVESTIGATOR, OR LAW ENFORCEMENT EMPLOYEE.
2222 SECTION 3. Section 37.08(a), Penal Code, is amended to read
2323 as follows:
2424 (a) A person commits an offense if, with intent to deceive,
2525 he knowingly makes a false statement that is material to a criminal
2626 investigation and makes the statement to:
2727 (1) a peace officer or federal special investigator
2828 conducting the investigation; or
2929 (2) any employee of a law enforcement agency that is
3030 authorized by the agency to conduct the investigation and that the
3131 actor knows is conducting the investigation.
3232 SECTION 4. Sections 38.04(a) and (b), Penal Code, are
3333 amended to read as follows:
3434 (a) A person commits an offense if he intentionally flees
3535 from a person he knows is a peace officer or federal special
3636 investigator attempting lawfully to arrest or detain him.
3737 (b) An offense under this section is a Class A misdemeanor,
3838 except that the offense is:
3939 (1) a state jail felony if:
4040 (A) the actor has been previously convicted under
4141 this section; or
4242 (B) the actor uses a vehicle while the actor is in
4343 flight and the actor has not been previously convicted under this
4444 section;
4545 (2) a felony of the third degree if:
4646 (A) the actor uses a vehicle while the actor is in
4747 flight and the actor has been previously convicted under this
4848 section; or
4949 (B) another suffers serious bodily injury as a
5050 direct result of an attempt by the officer or investigator from whom
5151 the actor is fleeing to apprehend the actor while the actor is in
5252 flight; or
5353 (3) a felony of the second degree if another suffers
5454 death as a direct result of an attempt by the officer or
5555 investigator from whom the actor is fleeing to apprehend the actor
5656 while the actor is in flight.
5757 SECTION 5. The heading to Section 38.14, Penal Code, is
5858 amended to read as follows:
5959 Sec. 38.14. TAKING OR ATTEMPTING TO TAKE WEAPON FROM PEACE
6060 OFFICER, FEDERAL SPECIAL INVESTIGATOR, EMPLOYEE OR OFFICIAL OF
6161 CORRECTIONAL FACILITY, PAROLE OFFICER, COMMUNITY SUPERVISION AND
6262 CORRECTIONS DEPARTMENT OFFICER, OR COMMISSIONED SECURITY OFFICER.
6363 SECTION 6. Sections 38.14(b), (c), (d), and (e), Penal
6464 Code, are amended to read as follows:
6565 (b) A person commits an offense if the person intentionally
6666 or knowingly and with force takes or attempts to take from a peace
6767 officer, federal special investigator, employee or official of a
6868 correctional facility, parole officer, community supervision and
6969 corrections department officer, or commissioned security officer
7070 the officer's, investigator's, employee's, or official's firearm,
7171 nightstick, stun gun, or personal protection chemical dispensing
7272 device with the intention of harming the officer, investigator,
7373 employee, or official or a third person.
7474 (c) The actor is presumed to have known that the peace
7575 officer, federal special investigator, employee or official of a
7676 correctional facility, parole officer, community supervision and
7777 corrections department officer, or commissioned security officer
7878 was a peace officer, federal special investigator, employee or
7979 official of a correctional facility, parole officer, community
8080 supervision and corrections department officer, or commissioned
8181 security officer if:
8282 (1) the officer, investigator, employee, or official
8383 was wearing a distinctive uniform or badge indicating his
8484 employment; or
8585 (2) the officer, investigator, employee, or official
8686 identified himself as a peace officer, federal special
8787 investigator, employee or official of a correctional facility,
8888 parole officer, community supervision and corrections department
8989 officer, or commissioned security officer.
9090 (d) It is a defense to prosecution under this section that
9191 the defendant took or attempted to take the weapon from a peace
9292 officer, federal special investigator, employee or official of a
9393 correctional facility, parole officer, community supervision and
9494 corrections department officer, or commissioned security officer
9595 who was using force against the defendant or another in excess of
9696 the amount of force permitted by law.
9797 (e) An offense under this section is:
9898 (1) a felony of the third degree, if the defendant took
9999 a weapon described by Subsection (b) from an officer, investigator,
100100 employee, or official described by that subsection; and
101101 (2) a state jail felony, if the defendant attempted to
102102 take a weapon described by Subsection (b) from an officer,
103103 investigator, employee, or official described by that subsection.
104104 SECTION 7. This Act takes effect September 1, 2011.
