88 AN ACT
99 relating to the selection of certain members of the board of
1010 directors of an appraisal district.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 6.03(c) and (e), Tax Code, are amended
1313 to read as follows:
1414 (c) Members of the board of directors other than a county
1515 assessor-collector serving as a nonvoting director are appointed by
1616 vote of the governing bodies of the incorporated cities and towns,
1717 the school districts, the junior college districts, and, if
1818 entitled to vote, the conservation and reclamation districts that
1919 participate in the district and of the county. A governing body may
2020 cast all its votes for one candidate or distribute them among
2121 candidates for any number of directorships. Conservation and
2222 reclamation districts are not entitled to vote unless at least one
2323 conservation and reclamation district in the district delivers to
2424 the chief appraiser a written request to nominate and vote on the
2525 board of directors by June 1 of each odd-numbered year. On receipt
2626 of a request, the chief appraiser shall certify a list by June 15 of
2727 all eligible conservation and reclamation districts that are
2828 imposing taxes and that participate in the district.
2929 (e) The chief appraiser shall calculate the number of votes
3030 to which each taxing unit other than a conservation and reclamation
3131 district is entitled and shall deliver written notice to each of
3232 those units of its voting entitlement before October 1 of each
3333 odd-numbered year. The chief appraiser shall deliver the notice:
3434 (1) to the county judge and each commissioner of the
3535 county served by the appraisal district;
3636 (2) to the presiding officer of the governing body of
3737 each city or town participating in the appraisal district, to the
3838 city manager of each city or town having a city manager, and to the
3939 city secretary or clerk, if there is one, of each city or town that
4040 does not have a city manager; [and]
4141 (3) to the presiding officer of the governing body of
4242 each school district participating in the district and to the
4343 superintendent of those school districts; and
4444 (4) to the presiding officer of the governing body of
4545 each junior college district participating in the district and to
4646 the president, chancellor, or other chief executive officer of
4747 those junior college districts.
4848 SECTION 2. The change in law made by this Act applies only
4949 to the selection of appraisal district directors for terms
5050 beginning on or after January 1, 2012. The change in law made by
5151 this Act does not affect the selection of appraisal district
5252 directors for terms beginning before that date.
5353 SECTION 3. This Act takes effect immediately if it receives
5454 a vote of two-thirds of all the members elected to each house, as
5555 provided by Section 39, Article III, Texas Constitution. If this
5656 Act does not receive the vote necessary for immediate effect, this
5757 Act takes effect September 1, 2011.
