9 | 9 | | relating to the selection of certain members of the board of |

10 | 10 | | directors of an appraisal district. |

11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Sections 6.03(c) and (e), Tax Code, are amended |
---|
13 | 13 | | to read as follows: |
---|
14 | 14 | | (c) Members of the board of directors other than a county |
---|
15 | 15 | | assessor-collector serving as a nonvoting director are appointed by |
---|
16 | 16 | | vote of the governing bodies of the incorporated cities and towns, |
---|
17 | 17 | | the school districts, the junior college districts, and, if |
---|
18 | 18 | | entitled to vote, the conservation and reclamation districts that |
---|
19 | 19 | | participate in the district and of the county. A governing body may |
---|
20 | 20 | | cast all its votes for one candidate or distribute them among |
---|
21 | 21 | | candidates for any number of directorships. Conservation and |
---|
22 | 22 | | reclamation districts are not entitled to vote unless at least one |
---|
23 | 23 | | conservation and reclamation district in the district delivers to |
---|
24 | 24 | | the chief appraiser a written request to nominate and vote on the |
---|
25 | 25 | | board of directors by June 1 of each odd-numbered year. On receipt |
---|
26 | 26 | | of a request, the chief appraiser shall certify a list by June 15 of |
---|
27 | 27 | | all eligible conservation and reclamation districts that are |
---|
28 | 28 | | imposing taxes and that participate in the district. |
---|
29 | 29 | | (e) The chief appraiser shall calculate the number of votes |
---|
30 | 30 | | to which each taxing unit other than a conservation and reclamation |
---|
31 | 31 | | district is entitled and shall deliver written notice to each of |
---|
32 | 32 | | those units of its voting entitlement before October 1 of each |
---|
33 | 33 | | odd-numbered year. The chief appraiser shall deliver the notice: |
---|
34 | 34 | | (1) to the county judge and each commissioner of the |
---|
35 | 35 | | county served by the appraisal district; |
---|
36 | 36 | | (2) to the presiding officer of the governing body of |
---|
37 | 37 | | each city or town participating in the appraisal district, to the |
---|
38 | 38 | | city manager of each city or town having a city manager, and to the |
---|
39 | 39 | | city secretary or clerk, if there is one, of each city or town that |
---|
40 | 40 | | does not have a city manager; [and] |
---|
41 | 41 | | (3) to the presiding officer of the governing body of |
---|
42 | 42 | | each school district participating in the district and to the |
---|
43 | 43 | | superintendent of those school districts; and |
---|
44 | 44 | | (4) to the presiding officer of the governing body of |
---|
45 | 45 | | each junior college district participating in the district and to |
---|
46 | 46 | | the president, chancellor, or other chief executive officer of |
---|
47 | 47 | | those junior college districts. |
---|
48 | 48 | | SECTION 2. The change in law made by this Act applies only |
---|
49 | 49 | | to the selection of appraisal district directors for terms |
---|
50 | 50 | | beginning on or after January 1, 2012. The change in law made by |
---|
51 | 51 | | this Act does not affect the selection of appraisal district |
---|
52 | 52 | | directors for terms beginning before that date. |
---|
53 | 53 | | SECTION 3. This Act takes effect immediately if it receives |
---|
54 | 54 | | a vote of two-thirds of all the members elected to each house, as |
---|
55 | 55 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
56 | 56 | | Act does not receive the vote necessary for immediate effect, this |
---|
57 | 57 | | Act takes effect September 1, 2011. |
