10	10	relating to the board of hospital managers of the El Paso County
11	11	Hospital District.
12	12	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
13	13	SECTION 1. Section 281.021(e), Health and Safety Code, is
14	14	amended to read as follows:
15	15	(e) The El Paso County Commissioners Court shall appoint a
16	16	board composed of seven members, and shall by order provide for the
17	17	qualifications of appointees to the board.
18	18	SECTION 2. Subchapter B, Chapter 281, Health and Safety
19	19	Code, is amended by adding Section 281.0222 to read as follows:
20	20	Sec. 281.0222. QUALIFICATIONS FOR OFFICE. (a) This
21	21	section applies only to the El Paso County Hospital District.
22	22	(b) The El Paso County Commissioners Court may not appoint a
23	23	person to the board of hospital managers of the district if the
24	24	person is:
25	25	(1) an employee of El Paso County;
26	26	(2) a district employee; or
27	27	(3) related within the third degree of consanguinity
28	28	or affinity, as determined under Subchapter B, Chapter 573,
29	29	Government Code, to a member of the commissioners court or to a
30	30	person described by Subdivision (1) or (2).
31	31	SECTION 3. Section 281.031, Health and Safety Code, is
32	32	amended to read as follows:
33	33	Sec. 281.031. REMOVAL OF BOARD MEMBER. (a) A member of the
34	34	board of hospital managers of the El Paso County Hospital District
35	35	is considered to have resigned the member's position if the member:
36	36	(1) is absent from all the regularly scheduled board
37	37	and committee meetings that the member is eligible to attend during
38	38	a 90-day period; [or]
39	39	(2) is absent from more than half of the regularly
40	40	scheduled board and committee meetings that the member is eligible
41	41	to attend during a 12-month period;
42	42	(3) fails to pay a local tax, including an ad valorem
43	43	tax, when due; or
44	44	(4) would be ineligible to serve on the board as
45	45	provided by Section 281.0222.
46	46	(b) A resignation under Subsection (a) is effective
47	47	immediately on the date the absence, disqualifying conduct, or
48	48	ineligibility specified [or refusal prescribed] by Subsection (a)
49	49	occurs or exists.
50	50	SECTION 4. The changes in law made by this Act apply only to
51	51	an appointment to the board of hospital managers of the El Paso
52	52	County Hospital District made on or after the effective date of this
53	53	Act. An appointment to the board of hospital managers of the El
54	54	Paso County Hospital District that occurs before the effective date
55	55	of this Act is governed by the law in effect at the time the
56	56	appointment was made, and the former law is continued in effect for
57	57	that purpose.
58	58	SECTION 5. This Act takes effect immediately if it receives
59	59	a vote of two-thirds of all the members elected to each house, as
60	60	provided by Section 39, Article III, Texas Constitution. If this
61	61	Act does not receive the vote necessary for immediate effect, this
62	62	Act takes effect September 1, 2011.
