99 AN ACT
1010 relating to the board of hospital managers of the El Paso County
1111 Hospital District.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 281.021(e), Health and Safety Code, is
1414 amended to read as follows:
1515 (e) The El Paso County Commissioners Court shall appoint a
1616 board composed of seven members, and shall by order provide for the
1717 qualifications of appointees to the board.
1818 SECTION 2. Subchapter B, Chapter 281, Health and Safety
1919 Code, is amended by adding Section 281.0222 to read as follows:
2020 Sec. 281.0222. QUALIFICATIONS FOR OFFICE. (a) This
2121 section applies only to the El Paso County Hospital District.
2222 (b) The El Paso County Commissioners Court may not appoint a
2323 person to the board of hospital managers of the district if the
2424 person is:
2525 (1) an employee of El Paso County;
2626 (2) a district employee; or
2727 (3) related within the third degree of consanguinity
2828 or affinity, as determined under Subchapter B, Chapter 573,
2929 Government Code, to a member of the commissioners court or to a
3030 person described by Subdivision (1) or (2).
3131 SECTION 3. Section 281.031, Health and Safety Code, is
3232 amended to read as follows:
3333 Sec. 281.031. REMOVAL OF BOARD MEMBER. (a) A member of the
3434 board of hospital managers of the El Paso County Hospital District
3535 is considered to have resigned the member's position if the member:
3636 (1) is absent from all the regularly scheduled board
3737 and committee meetings that the member is eligible to attend during
3838 a 90-day period; [or]
3939 (2) is absent from more than half of the regularly
4040 scheduled board and committee meetings that the member is eligible
4141 to attend during a 12-month period;
4242 (3) fails to pay a local tax, including an ad valorem
4343 tax, when due; or
4444 (4) would be ineligible to serve on the board as
4545 provided by Section 281.0222.
4646 (b) A resignation under Subsection (a) is effective
4747 immediately on the date the absence, disqualifying conduct, or
4848 ineligibility specified [or refusal prescribed] by Subsection (a)
4949 occurs or exists.
5050 SECTION 4. The changes in law made by this Act apply only to
5151 an appointment to the board of hospital managers of the El Paso
5252 County Hospital District made on or after the effective date of this
5353 Act. An appointment to the board of hospital managers of the El
5454 Paso County Hospital District that occurs before the effective date
5555 of this Act is governed by the law in effect at the time the
5656 appointment was made, and the former law is continued in effect for
5757 that purpose.
5858 SECTION 5. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2011.
