| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 64.012(b), Election Code, is amended to | |
| 10 | 10 | read as follows: | |
| 11 | 11 | (b) An offense under this section is a felony of the second | |
| 12 | 12 | [third] degree unless the person is convicted of an attempt. In | |
| 13 | 13 | that case, the offense is a state jail felony [Class A misdemeanor]. | |
| 14 | 14 | SECTION 2. The change in law made by this Act in amending | |
| 15 | 15 | Section 64.012(b), Election Code, applies only to an offense | |
| 16 | 16 | committed on or after the effective date of this Act. An offense | |
| 17 | 17 | committed before the effective date of this Act is covered by the | |
| 18 | 18 | law in effect when the offense was committed, and the former law is | |
| 19 | 19 | continued in effect for that purpose. For purposes of this section, | |
| 20 | 20 | an offense is committed before the effective date of this Act if any | |
| 21 | 21 | element of the offense occurs before that date. | |
| 22 | 22 | SECTION 3. This Act takes effect September 1, 2011. |
