11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 382.0518, Health and Safety Code, is | |
13 | 13 | amended by adding Subsection (d-1) to read as follows: | |
14 | 14 | (d-1) The commission may not require an applicant for a | |
15 | 15 | permit to construct or modify a source other than a major emitting | |
16 | 16 | facility, as defined by Section 169 of the federal Clean Air Act (42 | |
17 | 17 | U.S.C. Section 7479), to demonstrate that the source complies with | |
18 | 18 | a national ambient air quality standard unless compliance with the | |
19 | 19 | standard is required for that source by: | |
20 | 20 | (1) the state implementation plan adopted to | |
21 | 21 | implement, maintain, and enforce that standard in accordance with | |
22 | 22 | Section 110 of the federal Clean Air Act (42 U.S.C. Section 7410); | |
23 | 23 | (2) the federal Clean Air Act; or | |
24 | 24 | (3) another provision of this chapter. | |
25 | 25 | SECTION 2. This Act takes effect September 1, 2011. |
