 A BILL TO BE ENTITLED
 AN ACT
 relating to information used by the Electric Reliability Council of
 Texas to settle or resettle a market participant's load or certain
 trade days.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Section 39.151, Utilities Code, is amended by
 adding Subsection (n) to read as follows:
 (n)  To settle or resettle a market participant's load or a
 market participant's trade day in which digital or real time meters
 are not used or not otherwise in service, an independent
 organization certified by the commission under this section shall
 use any information available to the organization, including
 information from a TDU meter or other meter, electric service
 identifier or other identifier information, and premise or circuit
 information.
 SECTION 2.  The change in law made by this Act applies only
 to the settlement or resettlement of a market participant's load or
 trade day that occurs on or after January 1, 2011.
 SECTION 3.  This Act takes effect September 1, 2011.
