99 relating to transition and employment services for public school
1010 students enrolled in special education programs.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 29.011, Education Code, is amended to
1313 read as follows:
1414 Sec. 29.011. TRANSITION PLANNING. (a) The commissioner
1515 shall by rule adopt procedures for compliance with federal
1616 requirements relating to transition services for students who are
1717 enrolled in special education programs under this subchapter. The
1818 procedures must:
1919 (1) provide that appropriate state transition
2020 planning begins for a student not later than when the student
2121 reaches 14 years of age; and
2222 (2) specify the manner in which a student's admission,
2323 review, and dismissal committee must consider, and if appropriate,
2424 address the following issues in the student's individualized
2525 education program:
2626 (A) [(1)] appropriate student involvement in the
2727 student's transition to life outside the public school system;
2828 (B) [(2)] if the student is younger than 18 years
2929 of age, appropriate parental involvement in the student's
3030 transition;
3131 (C) [(3)] if the student is at least 18 years of
3232 age, appropriate parental involvement in the student's transition,
3333 if the parent is invited to participate by the student or the school
3434 district in which the student is enrolled;
3535 (D) [(4)] any postsecondary education options;
3636 (E) [(5)] a functional vocational evaluation;
3737 (F) [(6)] employment goals and objectives;
3838 (G) [(7)] if the student is at least 18 years of
3939 age, the availability of age-appropriate instructional
4040 environments;
4141 (H) [(8)] independent living goals and
4242 objectives; and
4343 (I) [(9)] appropriate circumstances for
4444 referring a student or the student's parents to a governmental
4545 agency for services.
4646 (b) The commissioner shall require each school district or
4747 shared services arrangement to designate at least one employee to
4848 serve as the district's or shared services arrangement's designee
4949 on transition and employment services for students enrolled in
5050 special education programs under this subchapter. The commissioner
5151 shall develop minimum training guidelines for a district's or
5252 shared services arrangement's designee. An individual designated
5353 under this subsection must provide information and resources about
5454 effective transition planning and services and interagency
5555 coordination to ensure that local school staff communicate and
5656 collaborate with:
5757 (1) students enrolled in special education programs
5858 under this subchapter and the parents of those students; and
5959 (2) as appropriate, local and regional staff of the:
6060 (A) Health and Human Services Commission;
6161 (B) Department of Aging and Disability Services;
6262 (C) Department of Assistive and Rehabilitative
6363 Services;
6464 (D) Department of State Health Services; and
6565 (E) Department of Family and Protective
6666 Services.
6767 SECTION 2. Subchapter A, Chapter 29, Education Code, is
6868 amended by adding Section 29.0111 to read as follows:
6969 Sec. 29.0111. TRANSITION AND EMPLOYMENT GUIDE. (a) The
7070 agency, with assistance from the Health and Human Services
7171 Commission, shall develop a transition and employment guide for
7272 students enrolled in special education programs and their parents
7373 to provide information on statewide services and programs that
7474 assist in the transition to life outside the public school system.
7575 The agency may contract with a private entity to prepare the guide.
7676 (b) The transition and employment guide must contain
7777 information specific to this state regarding:
7878 (1) transition services;
7979 (2) employment and supported employment services;
8080 (3) social security programs;
8181 (4) community and long-term services and support;
8282 (5) postsecondary educational programs and services;
8383 (6) information sharing with health and human services
8484 agencies and providers;
8585 (7) guardianship and alternatives to guardianship;
8686 (8) self-advocacy, person-directed planning, and
8787 self-determination; and
8888 (9) contact information for all relevant state
8989 agencies.
9090 (c) The transition and employment guide must be produced in
9191 an electronic format and posted on the agency's website in a manner
9292 that permits the guide to be easily identified and accessed.
9393 (d) The agency must update the transition and employment
9494 guide posted on the agency's website at least once every two years.
9595 (e) A school district shall:
9696 (1) post the transition and employment guide on the
9797 district's website if the district maintains a website; and
9898 (2) provide written information and, if necessary,
9999 assistance to a parent regarding how to access the electronic
100100 version of the guide at:
101101 (A) the first meeting of the student's admission,
102102 review, and dismissal committee at which transition is discussed;
103103 or
104104 (B) the first committee meeting that occurs after
105105 the date the guide becomes available, if a student has already had
106106 an admission, review, and dismissal committee meeting discussing
107107 transition.
108108 SECTION 3. The Texas Education Agency, with assistance from
109109 the Health and Human Services Commission, shall complete
110110 development of the guide required by Section 29.0111, Education
111111 Code, as added by this Act, not later than September 1, 2012. A
112112 school district shall comply with Section 29.0111(e), Education
113113 Code, as added by this Act, beginning on the date the guide is
114114 available.
115115 SECTION 4. Except as otherwise provided by this Act, this
116116 Act applies beginning with the 2011-2012 school year.
117117 SECTION 5. This Act takes effect immediately if it receives
118118 a vote of two-thirds of all the members elected to each house, as
119119 provided by Section 39, Article III, Texas Constitution. If this
120120 Act does not receive the vote necessary for immediate effect, this
121121 Act takes effect September 1, 2011.
