| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 11.0581, Education Code, is amended by |
|---|
| 13 | 13 | | adding Subsection (e) to read as follows: |
|---|
| 14 | 14 | | (e) This subsection applies only to a school district |
|---|
| 15 | 15 | | located in a county with a population of 3.3 million or more. The |
|---|
| 16 | 16 | | joint election agreement allocating expenses as provided by Section |
|---|
| 17 | 17 | | 271.004, Election Code, must provide that a school district is |
|---|
| 18 | 18 | | responsible only for the proportion of election expenses that |
|---|
| 19 | 19 | | corresponds to the proportion that the number of precincts located |
|---|
| 20 | 20 | | within the school district's boundaries bears to the total number |
|---|
| 21 | 21 | | of precincts participating in the joint election. The agreement |
|---|
| 22 | 22 | | must also provide that if a precinct is located within the |
|---|
| 23 | 23 | | boundaries of two or more school districts, each school district is |
|---|
| 24 | 24 | | responsible only for the proportion of election expenses that |
|---|
| 25 | 25 | | corresponds to the proportion that the number of the school |
|---|
| 26 | 26 | | district's registered voters in the precinct bears to the total |
|---|
| 27 | 27 | | number of registered voters in the precinct. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2011. |
