88 AN ACT
99 relating to training for employees and operators of certain
1010 child-care facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 42.0421, Human Resources Code, is
1313 amended by adding Subsections (f) and (g) to read as follows:
1414 (f) The training required by this section must be
1515 appropriately targeted and relevant to the age of the children who
1616 will receive care from the individual receiving training and must
1717 be provided by a person who:
1818 (1) is a training provider registered with the Texas
1919 Early Care and Education Career Development System's Texas Trainer
2020 Registry that is maintained by the Texas Head Start State
2121 Collaboration Office;
2222 (2) is an instructor at a public or private secondary
2323 school or at a public or private institution of higher education, as
2424 defined by Section 61.801, Education Code, who teaches early
2525 childhood development or another relevant course, as determined by
2626 rules adopted by the commissioner of education and the commissioner
2727 of higher education;
2828 (3) is an employee of a state agency with relevant
2929 expertise;
3030 (4) is a physician, psychologist, licensed
3131 professional counselor, social worker, or registered nurse;
3232 (5) holds a generally recognized credential or
3333 possesses documented knowledge relevant to the training the person
3434 will provide;
3535 (6) is a registered family home care provider or
3636 director of a day-care center or group day-care home in good
3737 standing with the department, if applicable, and who:
3838 (A) has demonstrated core knowledge in child
3939 development and caregiving; and
4040 (B) is only providing training at the home or
4141 center in which the provider or director and the person receiving
4242 training are employed; or
4343 (7) has at least two years of experience working in
4444 child development, a child development program, early childhood
4545 education, a childhood education program, or a Head Start or Early
4646 Head Start program and:
4747 (A) has been awarded a child development
4848 associate (CDA) credential; or
4949 (B) holds at least an associate's degree in child
5050 development, early childhood education, or a related field.
5151 (g) A person described by Subsection (f)(6) may provide
5252 training under this section only if the department has not taken an
5353 action under Section 42.071, 42.072, or 42.078, other than an
5454 evaluation, against the license, listing, or registration of the
5555 person or the home or center for which the person is a provider or
5656 director during the two-year period preceding the date on which the
5757 person provides the training.
5858 SECTION 2. This Act takes effect January 1, 2012.
