| 10 | 10 | | child-care facilities. |

| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 42.0421, Human Resources Code, is |
|---|
| 13 | 13 | | amended by adding Subsections (f) and (g) to read as follows: |
|---|
| 14 | 14 | | (f) The training required by this section must be |
|---|
| 15 | 15 | | appropriately targeted and relevant to the age of the children who |
|---|
| 16 | 16 | | will receive care from the individual receiving training and must |
|---|
| 17 | 17 | | be provided by a person who: |
|---|
| 18 | 18 | | (1) is a training provider registered with the Texas |
|---|
| 19 | 19 | | Early Care and Education Career Development System's Texas Trainer |
|---|
| 20 | 20 | | Registry that is maintained by the Texas Head Start State |
|---|
| 21 | 21 | | Collaboration Office; |
|---|
| 22 | 22 | | (2) is an instructor at a public or private secondary |
|---|
| 23 | 23 | | school or at a public or private institution of higher education, as |
|---|
| 24 | 24 | | defined by Section 61.801, Education Code, who teaches early |
|---|
| 25 | 25 | | childhood development or another relevant course, as determined by |
|---|
| 26 | 26 | | rules adopted by the commissioner of education and the commissioner |
|---|
| 27 | 27 | | of higher education; |
|---|
| 28 | 28 | | (3) is an employee of a state agency with relevant |
|---|
| 29 | 29 | | expertise; |
|---|
| 30 | 30 | | (4) is a physician, psychologist, licensed |
|---|
| 31 | 31 | | professional counselor, social worker, or registered nurse; |
|---|
| 32 | 32 | | (5) holds a generally recognized credential or |
|---|
| 33 | 33 | | possesses documented knowledge relevant to the training the person |
|---|
| 34 | 34 | | will provide; |
|---|
| 35 | 35 | | (6) is a registered family home care provider or |
|---|
| 36 | 36 | | director of a day-care center or group day-care home in good |
|---|
| 37 | 37 | | standing with the department, if applicable, and who: |
|---|
| 38 | 38 | | (A) has demonstrated core knowledge in child |
|---|
| 39 | 39 | | development and caregiving; and |
|---|
| 40 | 40 | | (B) is only providing training at the home or |
|---|
| 41 | 41 | | center in which the provider or director and the person receiving |
|---|
| 42 | 42 | | training are employed; or |
|---|
| 43 | 43 | | (7) has at least two years of experience working in |
|---|
| 44 | 44 | | child development, a child development program, early childhood |
|---|
| 45 | 45 | | education, a childhood education program, or a Head Start or Early |
|---|
| 46 | 46 | | Head Start program and: |
|---|
| 47 | 47 | | (A) has been awarded a child development |
|---|
| 48 | 48 | | associate (CDA) credential; or |
|---|
| 49 | 49 | | (B) holds at least an associate's degree in child |
|---|
| 50 | 50 | | development, early childhood education, or a related field. |
|---|
| 51 | 51 | | (g) A person described by Subsection (f)(6) may provide |
|---|
| 52 | 52 | | training under this section only if the department has not taken an |
|---|
| 53 | 53 | | action under Section 42.071, 42.072, or 42.078, other than an |
|---|
| 54 | 54 | | evaluation, against the license, listing, or registration of the |
|---|
| 55 | 55 | | person or the home or center for which the person is a provider or |
|---|
| 56 | 56 | | director during the two-year period preceding the date on which the |
|---|
| 57 | 57 | | person provides the training. |
|---|
| 58 | 58 | | SECTION 2. This Act takes effect January 1, 2012. |
