 A BILL TO BE ENTITLED
 AN ACT
 relating to a prohibition on the marketing of foods of minimal
 nutritional value on public school campuses.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  Chapter 12, Agriculture Code, is amended by
 adding Section 12.0022 to read as follows:
 Sec. 12.0022.  PROHIBITION ON MARKETING OF FOODS OF MINIMAL
 NUTRITIONAL VALUE ON PUBLIC SCHOOL CAMPUSES. (a)  A public school
 may not market or permit any other person to market a food of
 minimal nutritional value on the school campus.
 (b)  The department shall adopt rules as necessary for the
 administration of this section.  The rules must identify or
 establish criteria for identifying foods of minimal nutritional
 value.
 SECTION 2.  As soon as practicable after the effective date
 of this Act, the Department of Agriculture shall adopt rules for the
 administration of Section 12.0022, Agriculture Code, as added by
 this Act.
 SECTION 3.  This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution.  If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2011.
