| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. Section 223.042(c), Transportation Code, is |
|---|
| 15 | 15 | | amended to read as follows: |
|---|
| 16 | 16 | | (c) The department may award a contract under this section |
|---|
| 17 | 17 | | as a purchase of service under Subtitle D, Title 10, Government |
|---|
| 18 | 18 | | Code, if the department: |
|---|
| 19 | 19 | | (1) estimates that the contract will involve an amount |
|---|
| 20 | 20 | | for which a formal solicitation process for the purchase of |
|---|
| 21 | 21 | | services is not required under rules relating to the delegation of |
|---|
| 22 | 22 | | purchasing authority to state agencies adopted by the comptroller |
|---|
| 23 | 23 | | under Subchapter C, Chapter 2155, Government Code [less than |
|---|
| 24 | 24 | | $15,000]; and |
|---|
| 25 | 25 | | (2) determines that the competitive bidding procedure |
|---|
| 26 | 26 | | in this chapter is not practical. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2011. |
