99 A BILL TO BE ENTITLED
1010 AN ACT
1111 relating to certain privatization of maintenance contracts awarded
1212 by the Texas Department of Transportation.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 223.042(c), Transportation Code, is
1515 amended to read as follows:
1616 (c) The department may award a contract under this section
1717 as a purchase of service under Subtitle D, Title 10, Government
1818 Code, if the department:
1919 (1) estimates that the contract will involve an amount
2020 for which a formal solicitation process for the purchase of
2121 services is not required under rules relating to the delegation of
2222 purchasing authority to state agencies adopted by the comptroller
2323 under Subchapter C, Chapter 2155, Government Code [less than
2424 $15,000]; and
2525 (2) determines that the competitive bidding procedure
2626 in this chapter is not practical.
2727 SECTION 2. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2011.
