A BILL TO BE ENTITLED
AN ACT
relating to appointment of a department head of a fire or police
department in certain municipalities.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 143.013, Local Government Code, is
amended by adding Subsection (b-1) to read as follows:
(b-1) The city manager of a municipality may not be
appointed as department head of a fire or police department unless
the city manager satisfies the qualifications for appointment
appropriate for the position provided by Subsection (b).
SECTION 2. This Act takes effect immediately if it receives
a vote of two-thirds of all the members elected to each house, as
provided by Section 39, Article III, Texas Constitution. If this
Act does not receive the vote necessary for immediate effect, this
Act takes effect September 1, 2011.
