88 AN ACT
99 relating to prosecution of persons younger than 13 years of age for
1010 offenses involving disorderly conduct, disruption of public school
1111 classes, or disruption of public school transportation.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 37.124, Education Code, is amended by
1414 adding Subsection (d) to read as follows:
1515 (d) It is an exception to the application of Subsection (a)
1616 that the actor was younger than 13 years of age at the time the actor
1717 engaged in conduct prohibited under that subsection.
1818 SECTION 2. Section 37.126, Education Code, is amended by
1919 amending Subsection (a) and adding Subsection (c) to read as
2020 follows:
2121 (a) Except as provided by Section 37.125, a person commits
2222 an offense if the person intentionally disrupts, prevents, or
2323 interferes with the lawful transportation of children:
2424 (1) to or from school on a vehicle owned or operated by
2525 a county or independent school district; or
2626 (2) to or from [or] an activity sponsored by a school
2727 on a vehicle owned or operated by a county or independent school
2828 district.
2929 (c) It is an exception to the application of Subsection
3030 (a)(1) that the actor was younger than 13 years of age at the time
3131 the actor engaged in conduct prohibited under that subdivision.
3232 SECTION 3. Section 42.01, Penal Code, is amended by adding
3333 Subsection (f) to read as follows:
3434 (f) It is an exception to the application of Subsections
3535 (a)(1) through (6) that the actor was younger than 13 years of age
3636 at the time the actor engaged in conduct prohibited under those
3737 subdivisions and the prohibited conduct occurred at a public school
3838 campus during regular school hours.
3939 SECTION 4. The change in law made by this Act applies only
4040 to an offense committed on or after the effective date of this Act.
4141 An offense committed before the effective date of this Act is
4242 governed by the law in effect on the date the offense was committed,
4343 and the former law is continued in effect for that purpose. For
4444 purposes of this section, an offense was committed before the
4545 effective date of this Act if any element of the offense occurred
4646 before that date.
4747 SECTION 5. This Act takes effect September 1, 2011.
