By: Guillen H.B. No. 3775 A BILL TO BE ENTITLED AN ACT relating to deer breeder operations; providing penalties. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Subchapter L, Chapter 43, Parks and Wildlife Code, is amended by adding Section 43.3511 to read as follows: Section 43.3511. OWNER OF DEER. (a) A deer purchased by a deer breeder in accordance with this subchapter or a deer born in the deer breeder's facility in accordance with this subchapter is the personal property of the deer breeder. (b) To the extent of a conflict, this section controls over Section 1.011 or 1.013. (c) Any deer released into the wild from a deer breeding facility is no longer personal property and becomes property of the state. d. Any deer which escapes from a deer breeder facility, or escapes in transit between deer breeder facilities, and is not recaptured within 48 hours, is no longer personal property and becomes property of the state. (e). Any person who releases a deer from a deer breeder facility without authorization to do so may be charged with theft on a complaint made by the owner of the deer at the time it was released. SECTION 2. The changes in law made by this Act apply to all inspections, investigations or actions that take place on or after the effective date of this Act. An inspection, investigation or action taken before the effective date of this Act is governed by the law as it existed immediately before the effective date of this Act, and that law is continued in effect for that purpose.
