| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 24.165, Government Code, is amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | Sec. 24.165. 63RD JUDICIAL DISTRICT ([EDWARDS,] KINNEY, |
|---|
| 15 | 15 | | TERRELL, AND VAL VERDE COUNTIES). (a) The 63rd Judicial District |
|---|
| 16 | 16 | | is composed of [Edwards,] Kinney, Terrell, and Val Verde counties. |

| 17 | 17 | | (b) The terms of the 63rd District Court begin: |
|---|
| 18 | 18 | | (1) [in Edwards County on the first Monday in May and |
|---|
| 19 | 19 | | the third Monday in October; |
|---|
| 20 | 20 | | [(2)] in Kinney County on the first Mondays in April |
|---|
| 21 | 21 | | and October; |
|---|
| 22 | 22 | | (2) [(3)] in Terrell County on the first Monday in |
|---|
| 23 | 23 | | February and the third Monday in August; and |
|---|
| 24 | 24 | | (3) [(4)] in Val Verde County on the first Mondays in |
|---|
| 25 | 25 | | January and June. |

| 26 | 26 | | SECTION 2. The heading to Section 24.377, Government Code, |
|---|
| 27 | 27 | | is amended to read as follows: |

| 28 | 28 | | Sec. 24.377. 198TH JUDICIAL DISTRICT (EDWARDS, KERR, |

| 29 | 29 | | KIMBLE, MCCULLOCH, MASON, AND MENARD COUNTIES). |

| 30 | 30 | | SECTION 3. Section 24.377(a), Government Code, is amended |
|---|
| 31 | 31 | | to read as follows: |

| 32 | 32 | | (a) The 198th Judicial District is composed of Edwards, |
|---|
| 33 | 33 | | Kerr, Kimble, McCulloch, Mason, and Menard counties. |
|---|
| 34 | 34 | | SECTION 4. (a) The local administrative district judge |
|---|
| 35 | 35 | | shall transfer all cases from Edwards County that are pending in the |
|---|
| 36 | 36 | | 63rd District Court on the effective date of this Act to the 198th |
|---|
| 37 | 37 | | District Court. |
|---|
| 38 | 38 | | (b) When a case is transferred as provided by Subsection (a) |
|---|
| 39 | 39 | | of this section, all processes, writs, bonds, recognizances, or |
|---|
| 40 | 40 | | other obligations issued from the 63rd District Court are |
|---|
| 41 | 41 | | returnable to the 198th District Court as if originally issued by |
|---|
| 42 | 42 | | that court. The obligees on all bonds and recognizances taken in |
|---|
| 43 | 43 | | and for the 63rd District Court and all witnesses summoned to appear |
|---|
| 44 | 44 | | in the 63rd District Court are required to appear before the 198th |
|---|
| 45 | 45 | | District Court as if originally required to appear before that |
|---|
| 46 | 46 | | court. |
|---|
| 47 | 47 | | (c) On the effective date of this Act, a district court in |
|---|
| 48 | 48 | | this state shall promptly enter any order for substitution of |
|---|
| 49 | 49 | | counsel that is necessary to permit the appearance by the district |
|---|
| 50 | 50 | | attorney for the 198th Judicial District on behalf of this state for |
|---|
| 51 | 51 | | any case pending before the district court that has been |
|---|
| 52 | 52 | | transferred as provided by this Act. |
|---|
| 53 | 53 | | SECTION 5. This Act takes effect September 1, 2011. |
