99 AN ACT
1010 relating to the composition of certain judicial districts.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 24.165, Government Code, is amended to
1313 read as follows:
1414 Sec. 24.165. 63RD JUDICIAL DISTRICT ([EDWARDS,] KINNEY,
1515 TERRELL, AND VAL VERDE COUNTIES). (a) The 63rd Judicial District
1616 is composed of [Edwards,] Kinney, Terrell, and Val Verde counties.
1717 (b) The terms of the 63rd District Court begin:
1818 (1) [in Edwards County on the first Monday in May and
1919 the third Monday in October;
2020 [(2)] in Kinney County on the first Mondays in April
2121 and October;
2222 (2) [(3)] in Terrell County on the first Monday in
2323 February and the third Monday in August; and
2424 (3) [(4)] in Val Verde County on the first Mondays in
2525 January and June.
2626 SECTION 2. The heading to Section 24.377, Government Code,
2727 is amended to read as follows:
2828 Sec. 24.377. 198TH JUDICIAL DISTRICT (EDWARDS, KERR,
2929 KIMBLE, MCCULLOCH, MASON, AND MENARD COUNTIES).
3030 SECTION 3. Section 24.377(a), Government Code, is amended
3131 to read as follows:
3232 (a) The 198th Judicial District is composed of Edwards,
3333 Kerr, Kimble, McCulloch, Mason, and Menard counties.
3434 SECTION 4. (a) The local administrative district judge
3535 shall transfer all cases from Edwards County that are pending in the
3636 63rd District Court on the effective date of this Act to the 198th
3737 District Court.
3838 (b) When a case is transferred as provided by Subsection (a)
3939 of this section, all processes, writs, bonds, recognizances, or
4040 other obligations issued from the 63rd District Court are
4141 returnable to the 198th District Court as if originally issued by
4242 that court. The obligees on all bonds and recognizances taken in
4343 and for the 63rd District Court and all witnesses summoned to appear
4444 in the 63rd District Court are required to appear before the 198th
4545 District Court as if originally required to appear before that
4646 court.
4747 (c) On the effective date of this Act, a district court in
4848 this state shall promptly enter any order for substitution of
4949 counsel that is necessary to permit the appearance by the district
5050 attorney for the 198th Judicial District on behalf of this state for
5151 any case pending before the district court that has been
5252 transferred as provided by this Act.
5353 SECTION 5. This Act takes effect September 1, 2011.
