| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. Section 284.001, Parks and Wildlife Code, is |
|---|
| 14 | 14 | | amended by amending Subsections (a) and (d) and adding Subsection |
|---|
| 15 | 15 | | (f) to read as follows: |
|---|
| 16 | 16 | | (a) In this section: |
|---|
| 17 | 17 | | (1) "Archery equipment" means a longbow, recurved bow, |
|---|
| 18 | 18 | | compound bow, or crossbow. |
|---|
| 19 | 19 | | (2) "Firearm" has the meaning assigned by Section |
|---|
| 20 | 20 | | 62.014. |
|---|
| 21 | 21 | | (3) [(2)] "Navigable river or stream" has the meaning |
|---|
| 22 | 22 | | assigned by Section 90.001. |
|---|
| 23 | 23 | | (d) This section does not apply to: |
|---|
| 24 | 24 | | (1) an individual acting in the scope of the |
|---|
| 25 | 25 | | individual's duties as a peace officer or department employee; [or] |
|---|
| 26 | 26 | | (2) the discharge of a shotgun loaded with ammunition |
|---|
| 27 | 27 | | that releases only shot when discharged; or |
|---|
| 28 | 28 | | (3) an individual engaging in fishing using archery |
|---|
| 29 | 29 | | equipment, if the individual is in compliance with Subsection (f). |
|---|
| 30 | 30 | | (f) An individual engaging in fishing using archery |
|---|
| 31 | 31 | | equipment may not possess while fishing: |
|---|
| 32 | 32 | | (1) an arrow equipped with fletching of any kind; |
|---|
| 33 | 33 | | (2) an unbarbed arrow; or |
|---|
| 34 | 34 | | (3) a bow that is not equipped with a reel and line. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2011. |
