99 AN ACT
1010 relating to the authority of the Ector County Hospital District to
1111 employ and commission peace officers.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter C, Chapter 1024, Special District
1414 Local Laws Code, is amended by adding Section 1024.117 to read as
1515 follows:
1616 Sec. 1024.117. EMPLOYMENT OF DISTRICT PEACE OFFICERS. (a)
1717 The board may employ and commission peace officers for the
1818 district.
1919 (b) The jurisdiction of a peace officer commissioned under
2020 this section includes the property owned or controlled by the
2121 district.
2222 (c) In a district peace officer's jurisdiction, the peace
2323 officer has the authority granted by Chapter 14, Code of Criminal
2424 Procedure.
2525 SECTION 2. Article 2.12, Code of Criminal Procedure, is
2626 amended to read as follows:
2727 Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
2828 officers:
2929 (1) sheriffs, their deputies, and those reserve
3030 deputies who hold a permanent peace officer license issued under
3131 Chapter 1701, Occupations Code;
3232 (2) constables, deputy constables, and those reserve
3333 deputy constables who hold a permanent peace officer license issued
3434 under Chapter 1701, Occupations Code;
3535 (3) marshals or police officers of an incorporated
3636 city, town, or village, and those reserve municipal police officers
3737 who hold a permanent peace officer license issued under Chapter
3838 1701, Occupations Code;
3939 (4) rangers and officers commissioned by the Public
4040 Safety Commission and the Director of the Department of Public
4141 Safety;
4242 (5) investigators of the district attorneys', criminal
4343 district attorneys', and county attorneys' offices;
4444 (6) law enforcement agents of the Texas Alcoholic
4545 Beverage Commission;
4646 (7) each member of an arson investigating unit
4747 commissioned by a city, a county, or the state;
4848 (8) officers commissioned under Section 37.081,
4949 Education Code, or Subchapter E, Chapter 51, Education Code;
5050 (9) officers commissioned by the General Services
5151 Commission;
5252 (10) law enforcement officers commissioned by the
5353 Parks and Wildlife Commission;
5454 (11) airport police officers commissioned by a city
5555 with a population of more than 1.18 million that operates an airport
5656 that serves commercial air carriers;
5757 (12) airport security personnel commissioned as peace
5858 officers by the governing body of any political subdivision of this
5959 state, other than a city described by Subdivision (11), that
6060 operates an airport that serves commercial air carriers;
6161 (13) municipal park and recreational patrolmen and
6262 security officers;
6363 (14) security officers and investigators commissioned
6464 as peace officers by the comptroller;
6565 (15) officers commissioned by a water control and
6666 improvement district under Section 49.216, Water Code;
6767 (16) officers commissioned by a board of trustees
6868 under Chapter 54, Transportation Code;
6969 (17) investigators commissioned by the Texas Medical
7070 Board;
7171 (18) officers commissioned by:
7272 (A) the board of managers of the Dallas County
7373 Hospital District, the Tarrant County Hospital District, or the
7474 Bexar County Hospital District under Section 281.057, Health and
7575 Safety Code; and
7676 (B) the board of directors of the Ector County
7777 Hospital District under Section 1024.117, Special District Local
7878 Laws Code;
7979 (19) county park rangers commissioned under
8080 Subchapter E, Chapter 351, Local Government Code;
8181 (20) investigators employed by the Texas Racing
8282 Commission;
8383 (21) officers commissioned under Chapter 554,
8484 Occupations Code;
8585 (22) officers commissioned by the governing body of a
8686 metropolitan rapid transit authority under Section 451.108,
8787 Transportation Code, or by a regional transportation authority
8888 under Section 452.110, Transportation Code;
8989 (23) investigators commissioned by the attorney
9090 general under Section 402.009, Government Code;
9191 (24) security officers and investigators commissioned
9292 as peace officers under Chapter 466, Government Code;
9393 (25) an officer employed by the Department of State
9494 Health Services under Section 431.2471, Health and Safety Code;
9595 (26) officers appointed by an appellate court under
9696 Subchapter F, Chapter 53, Government Code;
9797 (27) officers commissioned by the state fire marshal
9898 under Chapter 417, Government Code;
9999 (28) an investigator commissioned by the commissioner
100100 of insurance under Section 701.104, Insurance Code;
101101 (29) apprehension specialists and inspectors general
102102 commissioned by the Texas Youth Commission as officers under
103103 Sections 61.0451 and 61.0931, Human Resources Code;
104104 (30) officers appointed by the inspector general of
105105 the Texas Department of Criminal Justice under Section 493.019,
106106 Government Code;
107107 (31) investigators commissioned by the Commission on
108108 Law Enforcement Officer Standards and Education under Section
109109 1701.160, Occupations Code;
110110 (32) commission investigators commissioned by the
111111 Texas Private Security Board under Section 1702.061(f),
112112 Occupations Code;
113113 (33) the fire marshal and any officers, inspectors, or
114114 investigators commissioned by an emergency services district under
115115 Chapter 775, Health and Safety Code;
116116 (34) officers commissioned by the State Board of
117117 Dental Examiners under Section 254.013, Occupations Code, subject
118118 to the limitations imposed by that section;
119119 (35) investigators commissioned by the Texas Juvenile
120120 Probation Commission as officers under Section 141.055, Human
121121 Resources Code; and
122122 (36) the fire marshal and any related officers,
123123 inspectors, or investigators commissioned by a county under
124124 Subchapter B, Chapter 352, Local Government Code.
125125 SECTION 3. This Act takes effect immediately if it receives
126126 a vote of two-thirds of all the members elected to each house, as
127127 provided by Section 39, Article III, Texas Constitution. If this
128128 Act does not receive the vote necessary for immediate effect, this
129129 Act takes effect September 1, 2011.
