1010 AN ACT
1111 relating to temporary directors and the continuation in existence
1212 of the Harris County Municipal Utility District No. 510.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. The heading to Subchapter A-1, Chapter 8240,
1515 Special District Local Laws Code, is amended to read as follows:
1616 SUBCHAPTER A-1. ORGANIZATION AND CONFIRMATION [TEMPORARY
1717 PROVISIONS]
1818 SECTION 2. Section 8240.021, Special District Local Laws
1919 Code, is amended by amending Subsection (d) and adding Subsections
2020 (e) and (f) to read as follows:
2121 (d) Temporary directors serve until the earlier of:
2222 (1) the date directors are elected under Section
2323 8240.023; or
2424 (2) the fourth anniversary of the effective date of
2525 the Act enacting this chapter [date this chapter expires under
2626 Section 8240.003].
2727 (e) If directors have not been elected under Section
2828 8240.023 and the terms of the temporary directors have expired,
2929 successor temporary directors shall be appointed or reappointed as
3030 provided by Subsection (f) to serve terms that expire on the earlier
3131 of:
3232 (1) the date directors are elected under Section
3333 8240.023; or
3434 (2) the fourth anniversary of the date of the
3535 appointment or reappointment.
3636 (f) If Subsection (e) applies, the owner or owners of a
3737 majority of the assessed value of the real property in the district
3838 may submit a petition to the Texas Commission on Environmental
3939 Quality requesting that the commission appoint as successor
4040 temporary directors the five persons named in the petition. The
4141 commission shall appoint as successor temporary directors the five
4242 persons named in the petition.
4343 SECTION 3. Sections 8240.003 and 8240.025, Special District
4444 Local Laws Code, are repealed.
4545 SECTION 4. Regardless of whether Section 8240.003, Special
4646 District Local Laws Code, is repealed on the same day that this Act
4747 takes effect, the Harris County Municipal Utility District No. 510
4848 is continued in existence and is not dissolved September 1, 2011.
4949 SECTION 5. (a) The legal notice of the intention to
5050 introduce this Act, setting forth the general substance of this
5151 Act, has been published as provided by law, and the notice and a
5252 copy of this Act have been furnished to all persons, agencies,
5353 officials, or entities to which they are required to be furnished
5454 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5555 Government Code.
5656 (b) The governor, one of the required recipients, has
5757 submitted the notice and Act to the Texas Commission on
5858 Environmental Quality.
5959 (c) The Texas Commission on Environmental Quality has filed
6060 its recommendations relating to this Act with the governor, the
6161 lieutenant governor, and the speaker of the house of
6262 representatives within the required time.
6363 (d) All requirements of the constitution and laws of this
6464 state and the rules and procedures of the legislature with respect
6565 to the notice, introduction, and passage of this Act are fulfilled
6666 and accomplished.
6767 SECTION 6. This Act takes effect immediately if it receives
6868 a vote of two-thirds of all the members elected to each house, as
6969 provided by Section 39, Article III, Texas Constitution. If this
7070 Act does not receive the vote necessary for immediate effect, this
7171 Act takes effect September 1, 2011.
