10	10	AN ACT
11	11	relating to temporary directors and the continuation in existence
12	12	of the Harris County Municipal Utility District No. 510.
13	13	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	14	SECTION 1. The heading to Subchapter A-1, Chapter 8240,
15	15	Special District Local Laws Code, is amended to read as follows:
16	16	SUBCHAPTER A-1. ORGANIZATION AND CONFIRMATION [TEMPORARY
17	17	PROVISIONS]
18	18	SECTION 2. Section 8240.021, Special District Local Laws
19	19	Code, is amended by amending Subsection (d) and adding Subsections
20	20	(e) and (f) to read as follows:
21	21	(d) Temporary directors serve until the earlier of:
22	22	(1) the date directors are elected under Section
23	23	8240.023; or
24	24	(2) the fourth anniversary of the effective date of
25	25	the Act enacting this chapter [date this chapter expires under
26	26	Section 8240.003].
27	27	(e) If directors have not been elected under Section
28	28	8240.023 and the terms of the temporary directors have expired,
29	29	successor temporary directors shall be appointed or reappointed as
30	30	provided by Subsection (f) to serve terms that expire on the earlier
31	31	of:
32	32	(1) the date directors are elected under Section
33	33	8240.023; or
34	34	(2) the fourth anniversary of the date of the
35	35	appointment or reappointment.
36	36	(f) If Subsection (e) applies, the owner or owners of a
37	37	majority of the assessed value of the real property in the district
38	38	may submit a petition to the Texas Commission on Environmental
39	39	Quality requesting that the commission appoint as successor
40	40	temporary directors the five persons named in the petition. The
41	41	commission shall appoint as successor temporary directors the five
42	42	persons named in the petition.
43	43	SECTION 3. Sections 8240.003 and 8240.025, Special District
44	44	Local Laws Code, are repealed.
45	45	SECTION 4. Regardless of whether Section 8240.003, Special
46	46	District Local Laws Code, is repealed on the same day that this Act
47	47	takes effect, the Harris County Municipal Utility District No. 510
48	48	is continued in existence and is not dissolved September 1, 2011.
49	49	SECTION 5. (a) The legal notice of the intention to
50	50	introduce this Act, setting forth the general substance of this
51	51	Act, has been published as provided by law, and the notice and a
52	52	copy of this Act have been furnished to all persons, agencies,
53	53	officials, or entities to which they are required to be furnished
54	54	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
55	55	Government Code.
56	56	(b) The governor, one of the required recipients, has
57	57	submitted the notice and Act to the Texas Commission on
58	58	Environmental Quality.
59	59	(c) The Texas Commission on Environmental Quality has filed
60	60	its recommendations relating to this Act with the governor, the
61	61	lieutenant governor, and the speaker of the house of
62	62	representatives within the required time.
63	63	(d) All requirements of the constitution and laws of this
64	64	state and the rules and procedures of the legislature with respect
65	65	to the notice, introduction, and passage of this Act are fulfilled
66	66	and accomplished.
67	67	SECTION 6. This Act takes effect immediately if it receives
68	68	a vote of two-thirds of all the members elected to each house, as
69	69	provided by Section 39, Article III, Texas Constitution. If this
70	70	Act does not receive the vote necessary for immediate effect, this
71	71	Act takes effect September 1, 2011.
