99 relating to the storage, transportation, and disposal of tires;
1010 providing criminal penalties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 361.1125(a)(1), Health and Safety Code,
1313 is amended to read as follows:
1414 (1) "Scrap tire" has the meaning assigned by Section
1515 361.471 [361.112].
1616 SECTION 2. Chapter 361, Health and Safety Code, is amended
1717 by adding Subchapter P to read as follows:
1818 SUBCHAPTER P. STORAGE, TRANSPORTATION, AND DISPOSAL OF USED
1919 OR SCRAP TIRES
2020 Sec. 361.471. DEFINITIONS. In this subchapter:
2121 (1) "Commission" means the Texas Commission on
2222 Environmental Quality.
2323 (2) "Generator" means:
2424 (A) a fleet operator;
2525 (B) an automotive dismantler; or
2626 (C) a new or used tire retailer, wholesaler,
2727 manufacturer, recapper, or retreader.
2828 (3) "Reusable tire" means a used tire that:
2929 (A) can be used for its original intended
3030 purpose;
3131 (B) has tire tread not less than one-sixteenth
3232 inch deep;
3333 (C) does not have chunking, bumps, knots, or
3434 bulges evidencing cord, ply, or tread separation from the casing or
3535 other adjacent material; and
3636 (D) does not have exposed tire cords or belting
3737 material as a result of damage to the tire.
3838 (4) "Scrap tire" means:
3939 (A) a used tire that a generator has rendered
4040 unusable; or
4141 (B) a tire that can no longer be used for its
4242 original intended purpose because it has:
4343 (i) tire tread less than one-sixteenth inch
4444 deep;
4545 (ii) chunking, bumps, knots, or bulges
4646 evidencing cord, ply, or tread separation from the casing or other
4747 adjacent material; or
4848 (iii) exposed tire cords or belting
4949 material as a result of damage to the tire.
5050 (5) "Transporter" means:
5151 (A) a person who transports used or scrap tires
5252 for compensation; or
5353 (B) a generator who transports used or scrap
5454 tires.
5555 Sec. 361.472. RULES. The commission by rule shall adopt
5656 application forms and procedures for the registration and
5757 permitting processes authorized under this subchapter.
5858 Sec. 361.473. STORAGE OF USED OR SCRAP TIRES; REGISTRATION
5959 REQUIRED. (a) A person may not store more than 500 used or scrap
6060 tires for any period on any publicly or privately owned property
6161 unless the person registers the storage site with the commission.
6262 This section does not apply to:
6363 (1) the storage, protection, or production of
6464 agricultural commodities; or
6565 (2) the temporary storage of used or scrap tires for
6666 eventual recycling, reuse, or energy recovery if the storage is
6767 approved by the commission.
6868 (b) The commission may register a site to store more than
6969 500 used or scrap tires.
7070 Sec. 361.474. STORAGE OF USED OR SCRAP TIRES; SHREDDING,
7171 SPLITTING, OR QUARTERING REQUIRED. (a) A person may not store
7272 more than 500 used or scrap tires unless the tires are shredded,
7373 split, or quartered as provided by commission rule. The commission
7474 may grant an exception to this requirement if the commission finds
7575 that circumstances warrant the exception.
7676 (b) The prohibition provided by Subsection (a) does not
7777 apply to:
7878 (1) a registered waste tire energy recovery facility
7979 or a waste tire energy recovery facility storage site; or
8080 (2) a person who, for eventual recycling, reuse, or
8181 energy recovery, temporarily stores used or scrap tires:
8282 (A) in a designated recycling collection area at
8383 a landfill permitted by the commission or licensed by a county or by
8484 a political subdivision exercising the authority granted by Section
8585 361.165; or
8686 (B) at another location approved by the
8787 commission for the temporary storage of used or scrap tires.
8888 Sec. 361.475. STORAGE OF TIRES IN CERTAIN LOCATIONS. The
8989 commission may adopt rules to regulate the storage of used, scrap,
9090 or shredded tires that are stored at a marine dock, rail yard, or
9191 trucking facility for more than 30 days.
9292 Sec. 361.476. TRANSPORTATION OF USED OR SCRAP TIRES;
9393 REGISTRATION REQUIRED. (a) Except as provided by commission rule,
9494 a transporter may not transport used or scrap tires unless the
9595 transporter registers with the commission.
9696 (b) A generator may register as a transporter.
9797 (c) A transporter may not transport reusable tires together
9898 with scrap tires unless the reusable and scrap tires are collected
9999 from a generator and transported directly to a tire processor, as
100100 defined by commission rule.
101101 (d) The commission by rule may exempt from the requirements
102102 of this section a type of transporter if the commission finds that
103103 circumstances support the exemption.
104104 Sec. 361.477. TRANSPORTATION OF USED OR SCRAP TIRES;
105105 MANIFEST AND ACCEPTABLE DESTINATIONS. (a) A transporter who
106106 transports used or scrap tires for storage or disposal shall
107107 maintain records and use a manifest or other appropriate
108108 documentation system as provided by commission rule to ensure that
109109 those tires are transported to:
110110 (1) a storage site that is registered under Section
111111 361.473;
112112 (2) a disposal facility that is permitted under
113113 Section 361.479 for that purpose;
114114 (3) if the tire is a reusable tire, a used tire dealer
115115 or other generator; or
116116 (4) another location allowed by commission rule
117117 adopted under Section 361.478.
118118 (b) A transporter who transports used or scrap tires for
119119 storage or disposal shall file with the commission the manifest or
120120 other appropriate documentation system used as required by this
121121 section.
122122 (c) The commission by rule may exempt from the requirements
123123 of this section a type of transporter if the commission finds that
124124 circumstances support the exemption.
125125 Sec. 361.478. TRANSPORTATION OF USED OR SCRAP TIRES FOR
126126 BENEFICIAL USE. The commission by rule shall authorize the
127127 transportation of used or scrap tires to a facility that will reuse
128128 the tires beneficially for purposes such as energy recovery,
129129 tire-derived fuel, septic drain fields, rubber mulch, crumb rubber,
130130 or reclamation projects.
131131 Sec. 361.479. DISPOSAL AT PERMITTED SITE REQUIRED. (a) A
132132 person may not dispose of used or scrap tires in a facility that is
133133 not permitted by the commission for that purpose.
134134 (b) The commission may issue a permit for a facility for the
135135 disposal of used or scrap tires.
136136 (c) The commission may amend, extend, transfer, or renew a
137137 permit issued under this section as provided by this chapter and
138138 commission rule.
139139 (d) The notice and hearing procedures provided by
140140 Subchapter C apply to a permit issued, amended, extended,
141141 transferred, or renewed under this section.
142142 (e) The commission may, for good cause, revoke or amend a
143143 permit issued under this section for a reason concerning public
144144 health, air or water pollution, land use, or a violation of this
145145 section, as provided by Section 361.089.
146146 Sec. 361.480. DISPOSAL OF USED OR SCRAP TIRES; SHREDDING,
147147 SPLITTING, OR QUARTERING REQUIRED. (a) A person may not dispose of
148148 any quantity of used or scrap tires unless the tires are shredded,
149149 split, or quartered as provided by commission rule. The commission
150150 may grant an exception to this requirement if the commission finds
151151 that circumstances warrant the exception.
152152 (b) Subsection (a) does not prohibit a person from storing
153153 used or scrap tires temporarily for eventual recycling, reuse, or
154154 energy recovery in a designated recycling collection area at a
155155 landfill:
156156 (1) permitted by the commission; or
157157 (2) licensed by a county or by a political subdivision
158158 exercising the authority granted by Section 361.165.
159159 Sec. 361.481. DUTY TO REPORT IMPROPER DISPOSAL OF TIRES. A
160160 political subdivision shall submit, at the time and in the form and
161161 manner required by the commission, a report notifying the
162162 commission of used or scrap tires disposed of at a location where
163163 the disposal is not authorized by permit.
164164 SECTION 3. Subchapter E, Chapter 7, Water Code, is amended
165165 by adding Section 7.1851 to read as follows:
166166 Sec. 7.1851. VIOLATIONS RELATING TO STORAGE,
167167 TRANSPORTATION, AND DISPOSAL OF USED OR SCRAP TIRES. (a) A person
168168 commits an offense if the person:
169169 (1) recklessly violates:
170170 (A) Section 361.473, Health and Safety Code;
171171 (B) Section 361.474, Health and Safety Code;
172172 (C) Section 361.476, Health and Safety Code;
173173 (D) Section 361.479, Health and Safety Code;
174174 (E) Section 361.480, Health and Safety Code; or
175175 (F) an order, permit, or exemption issued, or
176176 rule adopted, under Subchapter P, Chapter 361, Health and Safety
177177 Code; or
178178 (2) knowingly or intentionally violates:
179179 (A) Section 361.473, Health and Safety Code;
180180 (B) Section 361.474, Health and Safety Code;
181181 (C) Section 361.476, Health and Safety Code;
182182 (D) Section 361.479, Health and Safety Code;
183183 (E) Section 361.480, Health and Safety Code; or
184184 (F) an order, permit, or exemption issued, or
185185 rule adopted, under Subchapter P, Chapter 361, Health and Safety
186186 Code.
187187 (b) An offense under Subsection (a)(1) is a Class A
188188 misdemeanor.
189189 (c) An offense under Subsection (a)(2) is a state jail
190190 felony.
191191 SECTION 4. Section 7.302(a), Water Code, is amended to read
192192 as follows:
193193 (a) This section applies to a permit or exemption issued by
194194 the commission under:
195195 (1) Chapter 26, 27, 28, or 31 of this code;
196196 (2) Subchapter C, P, or R, Chapter 361, Health and
197197 Safety Code;
198198 (3) Subchapter D, Chapter 366, Health and Safety Code;
199199 (4) Chapter 382, Health and Safety Code; or
200200 (5) a rule adopted under any of those provisions.
201201 SECTION 5. Section 7.303(a), Water Code, is amended to read
202202 as follows:
203203 (a) This section applies to a license, certificate, or
204204 registration issued:
205205 (1) by the commission under:
206206 (A) Section 26.0301;
207207 (B) Chapter 37;
208208 (C) Section 361.0861 or[,] 361.092[, or
209209 361.112], Health and Safety Code;
210210 (D) Chapter 366, 371, or 401, Health and Safety
211211 Code; [or]
212212 (E) Chapter 1903, Occupations Code; or
213213 (F) Subchapter P, Chapter 361, Health and Safety
214214 Code;
215215 (2) by a county under Subchapter E, Chapter 361,
216216 Health and Safety Code; or
217217 (3) under a rule adopted under any of those
218218 provisions.
219219 SECTION 6. The following laws are repealed:
220220 (1) Section 361.112, Health and Safety Code; and
221221 (2) Section 7.304, Water Code.
222222 SECTION 7. Not later than May 1, 2012, the Texas Commission
223223 on Environmental Quality shall adopt rules as required by
224224 Subchapter P, Chapter 361, Health and Safety Code, as added by this
225225 Act.
226226 SECTION 8. This Act takes effect September 1, 2011.
