| 13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 14 | 14 | | SECTION 1. The heading to Section 550.025, Transportation |
|---|
| 15 | 15 | | Code, is amended to read as follows: |
|---|
| 16 | 16 | | Sec. 550.025. DUTY ON STRIKING STRUCTURE, FIXTURE, OR |
|---|
| 17 | 17 | | HIGHWAY LANDSCAPING. |
|---|
| 18 | 18 | | SECTION 2. Section 550.025(a), Transportation Code, is |
|---|
| 19 | 19 | | amended to read as follows: |
|---|
| 20 | 20 | | (a) The operator of a vehicle involved in an accident |
|---|
| 21 | 21 | | resulting only in damage to a structure adjacent to a highway or a |
|---|
| 22 | 22 | | fixture or landscaping legally on or adjacent to a highway shall: |
|---|
| 23 | 23 | | (1) take reasonable steps to locate and notify the |
|---|
| 24 | 24 | | owner or person in charge of the property of the accident and of the |
|---|
| 25 | 25 | | operator's name and address and the registration number of the |
|---|
| 26 | 26 | | vehicle the operator was driving; |
|---|
| 27 | 27 | | (2) if requested and available, show the operator's |
|---|
| 28 | 28 | | driver's license to the owner or person in charge of the property; |
|---|
| 29 | 29 | | and |
|---|
| 30 | 30 | | (3) report the accident if required by Section |
|---|
| 31 | 31 | | 550.061. |
|---|
| 32 | 32 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 33 | 33 | | in connection with a motor vehicle accident that occurs on or after |
|---|
| 34 | 34 | | the effective date of this Act. A motor vehicle accident that |
|---|
| 35 | 35 | | occurred before the effective date of this Act is governed by the |
|---|
| 36 | 36 | | law in effect on the date the accident occurred, and the former law |
|---|
| 37 | 37 | | is continued in effect for that purpose. |
|---|
| 38 | 38 | | SECTION 4. This Act takes effect September 1, 2011. |
