88 A BILL TO BE ENTITLED
99 AN ACT
1010 relating to the minimum standards for licensed child-care
1111 facilities and registered family homes.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. This Act shall be known as Paisley's Law.
1414 SECTION 2. Section 42.042(e), Human Resources Code, is
1515 amended to read as follows:
1616 (e) The department shall promulgate minimum standards that
1717 apply to licensed child-care facilities and to registered family
1818 homes covered by this chapter and that will:
1919 (1) promote the health, safety, and welfare of
2020 children attending a facility or registered family home;
2121 (2) promote safe, comfortable, and healthy physical
2222 facilities and registered family homes for children;
2323 (3) ensure adequate supervision of children by
2424 capable, qualified, and healthy personnel;
2525 (4) ensure adequate and healthy food service where
2626 food service is offered;
2727 (5) prohibit racial discrimination by child-care
2828 facilities and registered family homes;
2929 (6) require procedures for parental and guardian
3030 consultation in the formulation of children's educational and
3131 therapeutic programs; [and]
3232 (7) prevent the breakdown of foster care and adoptive
3333 placement; and
3434 (8) ensure that a child-care facility or registered
3535 family home:
3636 (A) follows the directions of a child's physician
3737 or other health care provider in providing specialized medical
3838 assistance required by the child; and
3939 (B) maintains for a reasonable time a copy of any
4040 directions from the physician or provider that the parent provides
4141 to the facility or home.
4242 SECTION 3. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2011.
